Having participated actively in both the WIPO and IFWP discussion lists, it is my considered opinion that WIPO should put off any further discussion of domain names as either trademarks or intellectual property until the new organization to replace the IANA has been constituted, so as not to distract from that difficult process and not to preempt the formation of channels of authoritative decision-making within it. By attempting to resolve or even elucidate issues not exclusively within its province, the current WIPO discussion on the present issues has done more harm than good. There is a time and place for everything; this is neither the time nor, despite WIPO's evident legal prerogatives, the place for discussing issues that have not yet been properly formulated.
