CHAPITRE I. - Du droit exclusif sur une topographie d'un produit semi- conducteur.
Section 1. - De l'objet et du titulaire du droit exclusif.
Article 1. Le créateur d'une topographie d'un produit semi-conducteur a le droit exclusif et temporaire de reproduire celle-ci de l'exploiter commercialement. Pour l'application de la présente loi, les termes topographie, produit semi-
conducteur et exploitation commerciale doivent être entendus dans le sens envisagé par la directive 87/54 du 16 décembre 1986 du Conseil des Communautés européennes concernant la protection juridique des topographies de produits semi- conducteurs ou dans le sens de toute modification décidée par le Conseil des Communautés européennes en application de l'article 1er, § 2, de cette directive.
Art. 2. La topographie d'un produit semi-conducteur est protégée dans la mesure où elle résulte de l'effort intellectuel de son créateur et n'est pas courante dans le secteur des semi-conducteurs. Lorsque la topographie d'un produit semi-conducteur est constituée d'éléments courants dans le secteur des semi-conducteurs, elle est protégée seulement dans la mesure où la combinaison de ces éléments, prise comme un tout, répond aux deux conditions ci-dessus.
Art. 3. La protection organisée par la présente loi concerne uniquement la topographie proprement dite, à l'exclusion de tout concept, procédé, système, technique ou information codée qui sont incorporés dans cette topographie.
Art. 4. § 1. Si une topographie d'un produit semi-conducteur est créée par un salarié dans l'exercice de ses fonctions, l'employeur est considéré comme créateur, sauf stipulation contraire. § 2. Si une topographie d'un produit semi-conducteur est créée sur commande,
celui qui a passé la commande est considéré comme créateur, sauf stipulation contraire.
Art. 5. Le droit à la protection, organisé par la présente loi, est transmissible aux ayants cause de la personne qui est titulaire de ce droit en vertu de la présente loi.
Section 2. - Des conditions relatives à la nationalité, la résidence ou l'établissement.
Art. 6. Le droit à la protection instauré par l'article 1er est accordé aux personnes physiques qui sont ressortissantes d'un Etat membre des Communautés européennes ou qui y ont leur résidence habituelle. Le droit à la protection accordé en vertu de l'article 4 est garanti aux personnes
physiques visées à l'alinéa 1er et aux sociétés ou autres personnes morales qui ont
un établissement industriel ou commercial effectif et sérieux sur le territoire d'un Etat membre des Communautés européennes.
Art. 7. Bénéficient également du droit à la protection organisé par la présente loi, les personnes visées aux articles 1er et 4 qui sont ressortissantes de pays autres que ceux visés à l'article 6, alinéa 2, ou qui y ont leur résidence habituelle ou un établissement industriel ou commercial effectif et sérieux, pour autant que cela ait été prévu par un instrument international ou décidé par le Conseil des Communautés européennes.
Art. 8. Lorsqu'il n'existe pas de droit à la protection en application de cette section, le droit à la protection vaut également pour les personnes mentionnées à l'article 6, alinéa 2, qui : a) procèdent à une première exploitation commerciale dans un Etat membre d'une
topographie qui n'a fait l'objet d'une exploitation commerciale nulle part ailleurs dans le monde antérieurement, et qui b) ont reçu de la personne habilitée à disposer de la topographie l'autorisation
exclusive de procéder à son exploitation commerciale dans toute la Communauté.
Section 3. - De la durée et de l'expiration du droit exclusif.
Art. 9. § 1. Le droit exclusif visé à l'article 1er naît lorsque la topographie est fixée ou codée pour la première fois. § 2. Le droit exclusif vient à expiration après une période de dix ans à compter de
la fin de l'année civile au cours de laquelle la topographie a fait l'objet d'une exploitation commerciale pour la première fois, où que ce soit dans le monde. § 3. Lorsqu'une topographie n'a pas fait l'objet d'une exploitation commerciale où
que ce soit dans le monde dans un délai de quinze ans à partir de la date à laquelle elle est fixée ou codée pour la première fois, le droit exclusif né en vertu du § 1er du présent article vient à expiration.
CHAPITRE II. - Des limitations du droit exclusif sur une topographie d'un produit semi-conducteur.
Art. 10. Le titulaire du droit à la protection d'une topographie d'un produit semi- conducteur ne peut faire valoir le droit exclusif de reproduction et d'exploitation commerciale accordé par la présente loi à l'égard de : a) la reproduction effectuée uniquement aux fins d'analyse, d'évaluation ou
d'enseignement de la topographie ou des concepts, procédés, systèmes ou techniques qui y sont incorporés; b) la topographie résultant d'analyses et d'évaluations d'une autre topographie
effectuées conformément aux dispositions du a, du moins dans la mesure où la nouvelle topographie résulte de l'effort intellectuel du créateur et n'est pas courante dans le secteur des semi-conducteurs.
Art. 11. § 1. Une personne qui acquiert un produit semi-conducteur sans savoir ou
sans être fondée à croire que la topographie de ce produit est protégée par le droit exclusif visé à l'article 1er ne peut se voir interdire l'exploitation commerciale de ce produit. § 2. Toutefois, le titulaire du droit exclusif peut exiger que cette personne lui verse
un montant équivalent à celui qui aurait normalement dû lui revenir au titre de l'exploitation commerciale de la topographie pour les actes commis après qu'elle sait ou est fondée à croire que la topographie du produit semi-conducteur est protégée par un droit exclusif.
Art. 12. Le droit exclusif visé à l'article 1er ne s'étend pas à l'exploitation commerciale d'une topographie ou d'un produit semi-conducteur après que celui-ci a été mis sur le marché dans un Etat membre des Communautés européennes par le titulaire du droit exclusif ou avec son consentement exprès.
CHAPITRE III. - Des actions concernant les droits sur une topographie d'un produit semi-conducteur.
Art. 13. <L 2007-05-09/30, art. 7, 003; En vigueur : 10-05-2007> § 1er. Sans préjudice du § 3, la partie lésée a droit à la réparation de tout préjudice
qu'elle subit du fait d'une atteinte au droit exclusif visé à l'article 1er. § 2. Lorsque l'étendue du préjudice ne peut être déterminée d'aucune autre
manière, le juge peut de manière raisonnable et équitable fixer un montant forfaitaire, à titre de dommages et intérêts. Le juge peut, à titre de dommages et intérêts, ordonner la délivrance à la partie
demanderesse des biens contrefaisants, ainsi que, dans les cas appropriés, des matériaux et instruments ayant principalement servi à la création ou à la fabrication de ces biens, et qui sont encore en possession du défendeur. Si la valeur de ces biens, matériaux et instruments dépasse l'étendue du dommage réel, le juge fixe la soulte à payer par le demandeur. En cas de mauvaise foi, le juge peut, à titre de dommages et intérêts, ordonner la
cession de tout ou partie du bénéfice réalisé à la suite de l'atteinte, ainsi qu'en reddition de compte à cet égard. Seuls les frais directement liés aux activités de contrefaçon concernées sont portés en déduction pour déterminer le bénéfice à céder. § 3. En cas de mauvaise foi, le juge peut prononcer au profit du demandeur la
confiscation des biens contrefaisants, ainsi que, dans les cas appropriés, des matériaux et instruments ayant principalement servi à la création ou à la fabrication de ces biens, et qui sont encore en possession du défendeur. Si les biens, matériaux et instruments ne sont plus en possession du défendeur, le juge peut allouer une somme égale au prix reçu pour les biens, matériaux et instruments cédés. La confiscation ainsi prononcée absorbe, à concurrence de la valeur de la confiscation, les dommages et intérêts.
Art. 14. <L 2007-05-09/30, art. 8, 003; En vigueur : 10-05-2007> § 1er. Lorsque le juge constate une atteinte au droit exclusif visé à l'article 1er, il ordonne la cessation de celle-ci à tout auteur de l'atteinte.
Le juge peut également rendre une injonction de cessation à l'encontre des intermédiaires dont les services sont utilisés par un tiers pour porter atteinte au droit exclusif visé à l'article 1er. § 2. Sans préjudice des éventuels dommages et intérêts dus à la partie lésée en
raison de l'atteinte et sans dédommagement d'aucune sorte, le juge peut ordonner à la demande de la partie habilitée à agir en contrefaçon le rappel des circuits commerciaux, la mise à l'écart définitive des circuits commerciaux ou la destruction des biens contrefaisants ainsi que, dans les cas appropriés, des matériaux et instruments ayant principalement servi à la création ou à la fabrication de ces biens. Ces mesures sont mises en oeuvre aux frais du contrevenant, à moins que des
raisons particulières ne s'y opposent. Lors de l'appréciation d'une demande visée à l'alinéa 1er, il sera tenu compte de la
proportionnalité entre la gravité de l'atteinte et les mesures ordonnées, ainsi que des intérêts des tiers. § 3. Lorsque dans le cadre d'une procédure, le juge constate une atteinte, il peut
ordonner, à la demande de la partie habilitée à agir en contrefaçon, à l'auteur de l'atteinte de fournir à la partie qui introduit cette action toutes les informations dont il dispose concernant l'origine et les réseaux de distribution des biens ou services contrefaisants et de lui communiquer toutes les données s'y rapportant, pour autant qu'il s'agisse d'une mesure justifiée et proportionnée. Une même injonction peut être faite à la personne qui a été trouvée en possession
des biens contrefaisants à l'échelle commerciale, qui a été trouvée en train d'utiliser des services contrefaisants à l'échelle commerciale ou qui a été trouvée en train de fournir, à l'échelle commerciale, des services utilisés dans des activités contrefaisantes. § 4. Le juge peut prescrire l'affichage de sa décision ou du résumé qu'il en rédige,
pendant le délai qu'il détermine, aussi bien à l'extérieur qu'à l'intérieur des établissements du contrevenant et ordonner la publication de son jugement ou du résumé par la voie de journaux ou de toute autre manière, le tout aux frais du contrevenant.
Art. 15. L'action pour cause d'atteinte au droit exclusif visé à l'article 1er se prescrit par cinq ans à compter du jour où l'infraction a été commise.
Art. 16. § 1. (Les tribunaux de commerce connaissent, même lorsque les parties ne sont pas commerçantes, de toutes les demandes relatives à l'application de la présente loi, quel que soit le montant de la demande.) <L 2007-05-10/33, art. 4, 002; En vigueur : 01-11-2007> § 2. Est seul compétent pour connaître de la demande visée au § 1er : 1° le tribunal établi au siège de la cour d'appel dans le ressort de laquelle
l'infraction a été commise ou, au choix du demandeur, le tribunal établi au siège de la cour d'appel dans le ressort de laquelle le défendeur ou un des défendeurs a son domicile ou sa résidence; 2° le tribunal établi au siège de la cour d'appel dans le ressort de laquelle le
demandeur à son domicile ou sa résidence, lorsque le défendeur, ou un des défendeurs, n'a pas de domicile ou de résidence dans le Royaume.
§ 3. Est nulle de plein droit toute convention contraire aux dispositions des §§ 1er et 2 du présent article, antérieure ou postérieure à la naissance du litige. La disposition de l'alinéa 1er ne fait toutefois pas obstacle à ce que les litiges visés
au présent article soient soumis à l'arbitrage. Par dérogation à l'article 630, alinéa 2, du Code judiciaire, les parties déterminent le lieu de l'arbitrage.
CHAPITRE IV. - Dispositions modificatives.
Art. 17. <disposition modificative des art. 569 et 627 du Code judiciaire>
CHAPITRE V. - Dispositions finales.
Art. 18. § 1. Les dispositions de la présente loi ne portent pas atteinte aux autres dispositions législatives en matière de propriété intellectuelle. § 2. Les dispositions de la présente loi ne portent pas atteinte à l'application du
droit d'auteur aux oeuvres qui seraient fixées dans le produit semi-conducteur.
Art. 19. La présente loi ne s'applique que pour les topographies de produits semi- conducteurs fixées ou codées pour la première fois après son entrée en vigueur.

HOOFDSTUK I. - Het exclusief recht op een topografie van een halfgeleiderprodukt.
Afdeling 1. - Het voorwerp en de houder van het exclusief recht.
Artikel 1. De maker van een topografie van een halfgeleiderprodukt heeft het exclusief en tijdelijk recht deze te reproduceren en ze commercieel te exploiteren.
Voor de toepassing van deze wet moeten de termen topografie, halfgeleiderprodukt en commerciële exploitatie verstaan worden in de zin bedoeld door de richtlijn 87/54 van 16 december 1986 van de Raad van de Europese Gemeenschappen betreffende de rechtsbescherming van topografieën van halfgeleiderprodukten of in de zin van elke wijziging besloten door de Raad van de Europese Gemeenschappen met toepassing van artikel 1, § 2, van die richtlijn.
Art. 2. De topografie van een halfgeleiderprodukt wordt slechts beschermd voor zover zij voldoet aan de voorwaarden dat zij het voortbrengsel is van de eigen intellectuele inspanning van de maker en in de halfgeleiderindustrie niet algemeen bekend is. Indien de topografie van een halfgeleiderprodukt bestaat uit in de halfgeleiderindustrie algemeen bekende bestanddelen, wordt zij slechts beschermd voor zover de combinatie van dergelijke bestanddelen, als één geheel bezien, aan de twee bovengenoemde voorwaarden voldoet.
Art. 3. De door deze wet georganiseerde bescherming betreft alleen de topografie zelf en strekt zich niet uit tot enige in de topografie belichaamde concepten, processen, systemen, technieken of gecodeerde informatie.
Art. 4. § 1. Indien een topografie van een halfgeleiderprodukt door een werknemer in de uitoefening van zijn functie is gemaakt, wordt, behoudens andersluidend beding, de werkgever als de maker beschouwd. § 2. Indien een topografie van een halfgeleiderprodukt op bestelling is gemaakt,
wordt, behoudens andersluidend beding, degene die de bestelling heeft gedaan, als de maker beschouwd.
Art. 5. Het recht op bescherming, georganiseerd door deze wet, gaat over op de rechtsopvolgers van de persoon die krachtens deze wet van dat recht houder is.
Afdeling 2. - Voorwaarden op het stuk van nationaliteit, verblijf of vestiging.
Art. 6. Het recht op bescherming ingesteld door artikel 1 komt toe aan de natuurlijke personen die onderdaan van een Lid-Staat van de Europese Gemeenschappen zijn of hun gewone verblijfplaats op het grondgebied van een Lid- Staat hebben. Het recht op bescherming toegekend krachtens artikel 4 komt toe aan de
natuurlijke personen als bedoeld in het eerste lid en aan de vennootschappen of andere rechtspersonen met een daadwerkelijke industriële of commerciële vestiging op het grondgebied van een Lid-Staat van de Europese Gemeenschappen.
Art. 7. Voor het recht op bescherming georganiseerd door deze wet komen eveneens in aanmerking personen als bedoeld in de artikelen 1 en 4 die onderdaan zijn van dan wel hun gewone verblijfplaats of daadwerkelijke industriële of commerciële vestiging hebben in andere dan de in artikel 6, tweede lid, bedoelde landen, indien zulks in een internationale overeenkomst is vastgesteld of door de Raad van Europese Gemeenschappen is besloten.
Art. 8. Wanneer er geen recht op bescherming bestaat krachtens deze afdeling, geldt het recht op bescherming ook voor de in artikel 6, tweede lid, bedoelde personen die : a) in een Lid-Staat voor het eerst een topografie commercieel exploiteren die nog
niet elders in de wereld commercieel is geëxploiteerd, en b) van degene die daarover kan beschikken, bij uitsluiting toestemming hebben
verkregen de topografie commercieel in de Gemeenschap te exploiteren.
Afdeling 3. - De duur en het verstrijken van het exclusief recht.
Art. 9. § 1. Het in artikel 1 bedoeld exclusief recht ontstaat wanneer de topografie voor het eerst op enigerlei wijze wordt vastgelegd. § 2. Het exclusief recht vervalt tien jaar na het verstrijken van het kalenderjaar
waarin de topografie voor het eerst ergens ter wereld commercieel geëxploiteerd is. § 3. Indien een topografie in een periode van vijftien jaar na de eerste vastlegging
nergens ter wereld commercieel is geëxploiteerd, vervalt het krachtens § 1 van dit artikel ontstaan exclusief recht.
HOOFDSTUK II. - De beperkingen van het exclusief recht op een topografie van een halfgeleiderprodukt.
Art. 10. De houder van het recht op bescherming van een topografie van een halfgeleiderprodukt kan het hem door deze wet verleend exclusief recht van reproductie en commerciële exploitatie niet doen gelden ten aanzien van : a) de reproductie die uitsluitend geschiedt voor de analyse, de evaluatie of het
onderwijzen van de topografie of van de concepten, processen, systemen of technieken die in de topografie belichaamd zijn; b) de topografie die het resultaat is van overeenkomstig het bepaalde in a verrichte
analyses en evaluaties van een andere topografie, althans in zover de nieuwe topografie het voortbrengsel is van de intellectuele inspanning van de maker en in de halfgeleiderindustrie niet algemeen bekend is.
Art. 11. § 1. Indien een persoon bij het verwerven van een halfgeleiderprodukt niet weet of niet redelijkerwijs kan vermoeden dat de topografie van dit produkt beschermd is door het in artikel 1 bedoeld exclusief recht, kan hem niet worden
verboden dat produkt commercieel te exploiteren. § 2. De houder van het exclusief recht kan evenwel van de in § 1 bedoelde persoon
een bedrag eisen gelijkwaardig aan het bedrag dat hem normaal zou toekomen uit hoofde van de commerciële exploitatie van de topografie voor de handelingen begaan nadat deze persoon weet of redelijkerwijs kan vermoeden dat de topografie van het halfgeleiderprodukt door een exclusief recht beschermd is.
Art. 12. Het in artikel 1 bedoelde exclusief recht geldt niet voor de commerciële exploitatie van een topografie of halfgeleiderprodukt nadat deze door de houder van het exclusief recht of met zijn uitdrukkelijke toestemming in een Lid-Staat van de Europese Gemeenschappen in het verkeer is gebracht.
HOOFDSTUK III. - De vorderingen betreffende de rechten op een topografie van een halfgeleiderprodukt.
Art. 13. <W 2007-05-09/30, art. 7, 003; Inwerkingtreding : 10-05-2007> § 1. Onverminderd § 3 heeft de benadeelde recht op de vergoeding van elke schade die hij door een inbreuk op het in artikel 1 bedoelde exclusief recht lijdt. § 2. Wanneer de omvang van de schade op geen andere wijze kan bepaald worden,
kan de rechter de schadevergoeding in redelijkheid en billijkheid vaststellen op een forfaitair bedrag. De rechter kan bij wijze van schadevergoeding de afgifte bevelen aan de eiser van
de inbreukmakende goederen, alsmede, in passende gevallen, van de materialen en werktuigen die voornamelijk bij de schepping of vervaardiging van die goederen zijn gebruikt, en die nog in het bezit van de verweerder zijn. Indien de waarde van die goederen, materialen en werktuigen de omvang van de werkelijke schade overschrijdt, bepaalt de rechter de door de eiser te betalen opleg. In geval van kwade trouw kan de rechter bij wijze van schadevergoeding de
afdracht bevelen van het geheel of een deel van de ten gevolge van de inbreuk genoten winst alsmede tot het afleggen van rekening en verantwoording dienaangaande. Bij het bepalen van de af te dragen winst worden enkel de kosten in mindering gebracht die rechtstreeks verbonden zijn aan de betrokken inbreukactiviteiten. § 3. In geval van kwade trouw kan de rechter de verbeurdverklaring uitspreken
ten voordele van de eiser van de inbreukmakende goederen, alsmede, in passende gevallen van de materialen en werktuigen die voornamelijk bij de schepping of vervaardiging van die goederen zijn gebruikt, en die nog in het bezit van de verweerder zijn. Indien de goederen, materialen en werktuigen niet meer in het bezit van de verweerder zijn kan de rechter een vergoeding toekennen waarvan het bedrag gelijk is aan de voor de verkochte goederen, materialen en werktuigen ontvangen prijs. De aldus uitgesproken verbeurdverklaring slorpt de schadevergoeding op ten belope van de waarde van het verbeurdverklaarde.
Art. 14. <W 2007-05-09/30, art. 8, 003; Inwerkingtreding : 10-05-2007> § 1. Wanneer de rechter een inbreuk op het in artikel 1 bedoelde exclusief recht vaststelt, beveelt deze tegenover elke inbreukmaker de staking van deze inbreuk.
De rechter kan eveneens een bevel tot staking uitvaardigen tegenover tussenpersonen wier diensten door derden worden gebruikt om inbreuk op het in artikel 1 bedoelde exclusief recht te plegen. § 2. Onverminderd de aan de benadeelde wegens de inbreuk verschuldigde
schadevergoeding en zonder schadeloosstelling van welke aard ook, kan de rechter op vordering van de partij die een vordering inzake namaak kan instellen de terugroeping uit het handelsverkeer, de definitieve verwijdering uit het handelsverkeer of de vernietiging gelasten van de inbreukmakende goederen, alsmede, in passende gevallen, van de materialen en werktuigen die voornamelijk bij de schepping of vervaardiging van die goederen zijn gebruikt. Deze maatregelen worden uitgevoerd op kosten van de inbreukmaker, tenzij
bijzondere redenen dit beletten. Bij de beoordeling van een vordering als bedoeld in het eerste lid, wordt rekening
gehouden met de evenredigheid tussen de ernst van de inbreuk en de gelaste maatregelen, alsmede met de belangen van derden. § 3. Wanneer de rechter in de loop van een procedure een inbreuk vaststelt, kan
hij, op verzoek van de partij die een vordering inzake namaak kan instellen, de inbreukmaker bevelen al hetgeen hem bekend is omtrent de herkomst en de distributiekanalen van de inbreukmakende goederen of diensten aan de partij die de vordering instelt mee te delen en haar alle daarop betrekking hebbende gegevens te verstrekken, voor zover die maatregel gerechtvaardigd en redelijk voorkomt. Eenzelfde bevel kan worden opgelegd aan de persoon die de inbreukmakende
goederen op commerciële schaal in zijn bezit heeft, de diensten waardoor een inbreuk wordt gemaakt op commerciële schaal heeft gebruikt, of op commerciële schaal diensten die bij inbreukmakende handelingen worden gebruikt, heeft verleend. § 4. De rechter kan bevelen dat zijn beslissing of de samenvatting die hij opstelt
wordt aangeplakt tijdens de door hem bepaalde termijn, zowel buiten als binnen de inrichtingen van de inbreukmaker en dat zijn vonnis of de samenvatting ervan in kranten of op enige andere wijze wordt bekendgemaakt, dit alles op kosten van de inbreukmaker.
Art. 15. De vordering wegens inbreuk op het exclusief recht bedoeld in artikel 1 verjaart na vijf jaar te rekenen vanaf de dag waarop de inbreuk werd gepleegd.
Art. 16. § 1. (De rechtbanken van koophandel nemen, zelfs wanneer de partijen geen kooplieden zijn, kennis van alle vorderingen aangaande de toepassing van deze wet, ongeacht het bedrag van de vordering.) <W 2007-05-10/33, art. 4, 002; Inwerkingtreding : 01-11-2007> § 2. Tot kennisneming van de vordering bedoeld in § 1 is alleen bevoegd : 1° de rechtbank die is gevestigd waar het hof van beroep zijn zetel heeft in het
rechtsgebied waarvan de inbreuk is begaan of, naar keuze van de eiser, de rechtbank die is gevestigd waar het hof van beroep zijn zetel heeft, in het rechtsgebied waarvan de verweerder of een van de verweerders zijn woon- of verblijfplaats heeft; 2° de rechtbank die is gevestigd waar het hof van beroep zijn zetel heeft, in het
rechtsgebied waarvan de eiser zijn woon- of verblijfplaats heeft, ingeval de verweerder, of een van de verweerders, in het Rijk geen woon- of verblijfplaats heeft. § 3. Van rechtswege is nietig elke overeenkomst die in strijd is met het bepaalde in
de §§ 1 en 2, van dit artikel, en die dagtekent van vóór of van na het ontstaan van het geschil. De bepaling van het eerste lid staat nochtans niet in de weg dat de geschillen
bedoeld in dit artikel voor een scheidsgerecht worden gebracht. In afwijking van het bepaalde in artikel 630, tweede lid, van het Gerechtelijk Wetboek, bepalen de partijen vrij de plaats waar het geding voor scheidslieden wordt gevoerd.
HOOFDSTUK IV. - Wijzigingsbepalingen.
Art. 17. <wijzigingsbepaling van art. 569 en 627 van het Gerechtelijk Wetboek>

Art. 18. § 1. De bepalingen van deze wet doen geen afbreuk aan de andere wettelijke bepalingen inzake intellectuele eigendom.
§ 2. De bepalingen van deze wet doen geen afbreuk aan de toepassing van het auteursrecht op de werken die in het halfgeleiderprodukt zouden zijn vastgelegd.
Art. 19. Deze wet is slechts van toepassing op de topografieën van halfgeleiderprodukten die voor de eerste maal na haar inwerkingtreding werden vastgelegd.

Chapter I Exclusive Right in a Topography of a
Semiconductor Product
Part 1 Subject Matter and Holder of the Exclusive Right
1.– The creator of a topography of a semiconductor product shall have the exclusive and temporary right
to reproduce and commercially exploit the topography. For the implementation of this Law, the terms topography, semiconductor product and commercial
exploitation shall be understood in the meaning defined in Directive 87/54 of December 16, 1986, of the Council of the European Communities on the Legal Protection of Topographies of Semiconductor Products or in any amendment decided by the Council of the European Communities under Article 1.2 of that Directive.
2.– The topography of a semiconductor product shall be protected insofar as it satisfies the conditions that
it is the result of its creator’s own intellectual effort and is not commonplace in the semiconductor industry. Where the topography of a semiconductor product consists of elements that are commonplace in the semiconductor industry, it shall be protected only to the extent that the combination of such elements, taken as a whole, fulfills the above-mentioned conditions.
3.– The protection afforded by this Law shall apply solely to the topography as such, to the exclusion of
any concept, process, system, technique or encoded information embodied in the topography.

4.– (1) Where a topography of a semiconductor product is created by an employee in the course of his
employment, the employer shall be deemed the creator, unless otherwise stipulated. (2) Where a topography of a semiconductor product is created on commission, the person who has
placed the commission shall be deemed to be the creator, unless otherwise stipulated.
5.– The right to protection afforded by this Law shall be transferable to the successors in title of the person
who holds the right in accordance with this Law.
Part 2 Conditions of Nationality, Residence
or Establishment
6.– The right to protection instituted by Section 1 shall be afforded to natural persons who are nationals of
a Member State of the European Communities or who have their habitual residence on the territory of a Member State.
The right to protection afforded under Section 4 shall apply in favor of the natural persons referred to in the first paragraph and to companies or other legal persons which have a real and effective industrial or commercial establishment on the territory of a Member State of the European Communities.
7.– The right to protection afforded by this Law shall also be available to those persons referred to in
Sections 1 and 4 who are nationals of or who have their habitual residence or a real and effective industrial or commercial establishment in countries other than those referred to in the second paragraph of Section 6 where provided by an international instrument or decided by the Council of the European Communities.
8.– Where no right to protection exists in accordance with this Part, the right to protection shall also apply
in favor of the persons referred to in the second paragraph of Section 6 who: (a) first commercially exploit within a Member State a topography which has not yet been
exploited commercially anywhere in the world; and (b) have been exclusively authorized to exploit commercially the topography throughout the
Community by the person entitled to dispose of it.
Part 3 Term and Expiry of the Exclusive Right
9.– (1) The exclusive right referred to in Section 1 shall come into existence when the topography is fixed
or encoded for the first time. (2) The exclusive right shall expire after a period of 10 years as from the end of the calendar year in
which the topography was first commercially exploited anywhere in the world. (3) Where a topography has not been commercially exploited anywhere in the world within a period of
15 years from the date on which it was first fixed or encoded, any exclusive right in existence pursuant to subsection (1) of this Section shall expire.
Chapter II Limitations on the Exclusive Right
in a Topography of a Semiconductor Product
10.– The holder of the right to protection of a topography of a semiconductor product may not assert his
exclusive right of reproduction or commercial exploitation afforded by this Law in respect of: (a) reproduction solely for the purposes of analysis, evaluation or teaching of the topography or the
concepts, processes, systems or techniques embodied in the topography; (b) a topography resulting from the analysis and evaluation of another topography carried out in
accordance with item (a), at least insofar as the new topography is the result of its creator’s own intellectual effort and is not commonplace in the semiconductor industry.
11.– (1) A person who, when he acquires a semiconductor product, does not know, or has no reasonable
grounds to believe, that the topography of the product is protected by an exclusive right under Section 1 shall not be prevented from commercially exploiting that product.
(2) However, the holder of the exclusive right may require such person to pay to him an amount equivalent to that which would have normally been due to him in respect of commercial exploitation of the topography for acts committed after such person knows or has reasonable grounds to believe that the topography of the semiconductor product is protected by an exclusive right.
12.– The exclusive right referred to in Section 1 shall not extend to the commercial exploitation of a
topography or of a semiconductor product after it has been put on the market in a Member State of the European Communities by the holder of the exclusive right or with his explicit consent.
Chapter III Action in Respect of Rights
in a Topography of a Semiconductor Product
13.– Notwithstanding the provisions of Section 14, the court shall order any infringer, at the request of the
injured party: 1. to cease the infringement; 2. to pay to the plaintiff an indemnity to make good the prejudice caused by the infringement.
The court may also order publication of its findings.
14.– In the event of bad faith, the court shall order confiscation in favor of the plaintiff of the
semiconductor products fabricated in infringement of the exclusive right referred to in Section 1 and of the instruments or means specially intended for their fabrication. If the semiconductor products have been transferred in return for payment or free of charge, the court shall add an amount equal to the price or the value of the semiconductor products already transferred.
15.– Action for infringement of the exclusive right referred to in Section 1 shall be barred after five years
from the day on which the infringement took place.
16.– (1) Claims in respect of topographies of semiconductor products shall be heard by the first instance
courts whatever the value of the claim.
Any claim based both on infringement of the exclusive right referred to in Section 1 and on an act contrary to fair trade practices shall be heard exclusively by the first instance court.
(2) Sole competence to hear a claim referred to in subsection (1) shall belong to: 1. the court established at the seat of the court of appeal in whose jurisdiction the
infringement has been committed or, at the choice of the plaintiff, the court established at the seat of the court of appeal in whose jurisdiction the defendant or one of the defendants has his domicile or residence;
2. the court established at the seat of the court of appeal in whose jurisdiction the plaintiff has his domicile or residence if the defendant, or one of the defendants, has no domicile or residence in the Kingdom.
(3) Any agreement contrary to the provisions of subsections (1) and (2) of this Section, whether prior to or subsequent to the existence of the dispute, shall be null and void.
However, the provision in subsection (1) shall not prevent disputes referred to in this Section from being taken to arbitration. By derogation from Section 630(2) of the Judicial Code, the parties shall determine the place of arbitration.
Chapter IV Amending Provisions
17.– (1) Article 569(1) of the Judicial Code, as amended by the Laws of November 3, 1967, May 7, 1973,
May 20, 1975, March 28, 1984, and June 28, 1984, shall be supplemented as follows: (2) Section 627 of that same Code, as amended by the Laws of June 24, 1970, June 30, 1971,

Chapter V Final Provisions
18.– (1) The provisions of this Law shall not prejudice any other statutory provisions in respect of
intellectual property. (2) The provisions of this Law shall not prejudice the application of copyright to works fixed in the
semiconductor product.
19.– This Law shall apply only to topographies of semiconductor products fixed or encoded for the first
time after its entry into force.
