Details Details Year of Version 2004 Dates Entry into force: March 23, 2004 Adopted: March 16, 2004 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Utility Models, IP Regulatory Body Notes This Dispatch is issued pursuant to Article 23(1) & Article 85(2), (3) of the Industrial Property Code (approved by Decree-Law No. 97/99/M of December 3, 1999).

Article 3 of this Dispatch states that it approves the application forms, published in the Annex I to the Dispatch, which should be used to request the Economics Services of Macao (DES) to extend the patent applications filed with the SIPO and patents granted by the SIPO as provided for in Article 135 of the IP Code 1999.

Article 4 of this Dispatch states that it shall come into force on the day following its publication (March 22, 2004), and the effective date of this Dispatch shall be retroactive to the signature date of the “Cooperation Agreement between the State Intellectual Property Office (SIPO) and the Macao SAR Economic Services in the field of Intellectual Property Rights”, which is January 24, 2003.

Despacho do Chefe do Executivo n.º 59/2004

Usando da faculdade conferida pelo artigo 50.º da Lei Básica da Região Administrativa Especial de Macau, e nos termos do n.º 1 do artigo 23.º e dos n.os 2 e 3 do artigo 85.º do Regime Jurídico da Propriedade Industrial, aprovado pelo Decreto-Lei n.º 97/99/M, de 13 de Dezembro, o Chefe do Executivo manda:

1. A Direcção Nacional da Propriedade Intelectual é designada, nos termos do n.º 2 do artigo 85.º do Regime Jurídico da Propriedade Industrial, como entidade habilitada a elaborar os relatórios de exame de invenção para efeitos de pedido de registo de patentes na Região Administrativa Especial de Macau.

2. Sempre que o requerente de registo de patente na Região Administrativa Especial de Macau solicitar que o relatório de exame da invenção seja efectuado pela entidade referida no n.º 1, deverá apresentar na Direcção dos Serviços de Economia todos os documentos necessários redigidos em língua chinesa, ou traduzidos para a língua chinesa.

3. É aprovado o modelo de impresso a utilizar, nos termos do artigo 135.º do Regime Jurídico da Propriedade Industrial, para o pedido de extensão à Região Administrativa Especial de Macau de patente concedida pela entidade referida no n.º 1 ou de pedido de patente a conceder pela mesma, que se publica como Anexo I.

4. O presente despacho entra em vigor no dia seguinte ao da sua publicação e tem efeitos retroactivos à data de assinatura do Acordo de Cooperação entre a Direcção Nacional da Propriedade Intelectual e a Direcção dos Serviços de Economia da Região Administrativa Especial de Macau na Área dos Direitos da Propriedade Intelectual.

行政長官行使《澳門特別行政區基本法》第五十條賦予的職權,並根據經十二月十三 日第 97/99/M號法令核准的《工業產權法律制度》第二十三條第一款及第八十五條第二款及第三款的規定,作 出本批示。

一、根據《工業產權法律制度》第八十五條第二款的規定,國家知識產權局作為具資 格的指定實體,為於澳門特別行政區的專利註冊申請製作發明的審查報告書。

二、當澳門特別行政區的專利註冊申請人要求由第一款所述的實體製作發明的審查報 告書時,於經濟局提交的一切所需文件必須以中文撰寫或翻譯成中文。

三、根據《工業產權法律制度》第一百三十五條的規定,核准使用於申請由第一款所 述的實體授予的專利或專利申請延伸至澳門特別行政區的印件格式,公佈於附件一。

四、本批示自公佈翌日起生效,其效力追溯至《國家知識產權局與澳門特別行政區經 濟局關於在知識產權領域合作的協議》的簽署日期。
