REGULATION concerning the Patent Office
Article 1
The Patent Office is a state institution under the ultimate jurisdiction of the Minister of Industry. The protection for the rights handled by the institution shall extend to all areas of Icelandic jurisdiction. The institution shall be located in Reykjavík.
Article 2 The role of the Patent Office shall be, in particular:
1) 2) 3) | to handle matters concerning patents, trade marks, design protection and other comparable rights provided for by law, in regulations and in international agreements on the protection of industrial property; to provide individuals, institutions and business enterprises with information and advice concerning intellectual property rights in industry; to encourage the making available of the new technology and knowledge which is involved in the registered intellectual property rights to the public. |
Article 3 |
The income of the institution shall be fees in accordance with the provisions of Regulations set on the basis of Acts on intellectual property rights in industry and other comparable service fees.
Article 4
The Minister of Industry shall appoint the Director of the Patent Office who shall function concurrently as Registrar of Trade Marks. The Director shall manage the institution, hire personnel and be responsible for its finances.
Article 5
The institution shall publish, for example: 1) a publication for the mandatory publishing and notifications concerning the protection of
industrial property rights, 2) patent applications which have been laid open for public inspection and registered patents, 3) an annual summary of intellectual property rights registered and changes to them, 4) instructions on the completion of applications in each area of protection. The institution shall send an annual summary to the World Intellectual Property Organisation (WIPO)
concerning industrial property rights.
Article 6
This Regulation is set with reference to Articles 7 and 69 of the Patents Act, No. 17/1991 and Articles 12 and 46 of the Trade Marks Act, No. 47/1968, cf. Act No. 31/1984. The Regulation shall enter into force 1 July 1991.
