On January 10, 2014, the Republic of Malawi deposited with the Swiss Federal Council the following declaration (original English version):
WHEREAS the Republic of Malawi is a contracting Party to the Geneva Conventions of 12 August, 1949, and Protocols I and II Additional thereto, of 8 June, 1977.
AND WHEREAS Article 90 (1) (a) of Protocol I Additional to the Geneva Conventions of 1949, and relating to the Protection of Victims of International
Armed Conflicts (Protocol I), of 1977 establishes an International Fact-Finding Commission (the Commission);
AND WHEREAS Article 90 (2) (a) of Protocol I provides that the High Contraction Parties may at the time of signing, ratifying or acceding to the Protocol, or at any other subsequent time, declare that they recognize ipso facto and without special agreement, in relation to any other High Contracting Party accepting the same obligation, the competence of the Commission to enquire into allegations by such other Party, as authorized by Article 90;
AND WHEREAS the Republic of Malawi did not make a declaration when signing, ratifying or acceding to the Protocol;
AND WHEREAS it is the wish of the Republic of Malawi to recognize the competence of the Commission;
NOW THEREFORE, I, DR. JOYCE BANDA, President of the Republic of Malawi, for and on behalf of the Government of the Republic of Malawi, DO HEREBY declare that the Republic of Malawi recognizes ipso facto and without special agreement, in relation to any other High Contracting Party accepting the same obligation, the competence of the International Fact-Finding Commission to enquire into allegations by such other Party, as authorized by Article 90 of Protocol I Additional to the Geneva Conventions of 1949.
