WIPO Webinar for Judges on June 2, 2021: Evaluating Similarity of Trademarks and Likelihood of Confusion in the Caribbean Region

In collaboration with the Caribbean Court of Justice (CCJ) Academy for Law, WIPO is pleased to offer this occasion for members of the judiciary in the Caribbean region to participate in an exchange of information and experiences of IP adjudication in the Caribbean region.
This webinar will consider common issues in the adjudication of trademark infringement disputes such as similarity of signs, likelihood of confusion, and assessment of well-known marks, with a focus on the recent decision of the Court of Appeal of Jamaica in 3M Company v. Manufacturera 3M SA DE CV [2017] JMCA Civ 21 (available in the WIPO Lex-Judgments database).
Justice Bryan Sykes, Chief Justice of the Supreme Court of Jamaica, will present this decision, and will be joined by Justice Nadia Kangaloo, Judge of the High Court of Trinidad and Tobago, for a discussion on how the questions raised have been treated by other courts across the region, including by reference to a historic decision of Fruit of the Loom Inc v. Chong Kong Man (1972) 20 WIR 445. The discussion will be moderated by Justice Winston Anderson, Judge of the Caribbean Court of Justice and Chairman of the CCJ Academy for Law. An introduction to the work of the CCJ Academy of Law will be provided by Justice Jacob Wit, Judge of the Caribbean Court of Justice.
The webinar will be conducted in English on June 2, 2021 at 11:00 a.m. – 12:30 p.m. (Eastern Caribbean time). Participation is open only to judges and members of quasi-judicial bodies that are active in adjudicating intellectual property disputes.
