WIPO-KCC Collaboration to resolve Copyright Disputes

The Korea Copyright Commission (KCC) and the WIPO Arbitration and Mediation Center (WIPO Center) collaborate to promote the use of Alternative Dispute Resolution (ADR) to resolve copyright related disputes. As part of the collaboration, parties to international disputes can opt for WIPO Mediation benefitting from a reduced fee scheme and the international expertise of WIPO neutrals.

ADR procedures, such as mediation and arbitration, constitute alternatives to court litigation. ADR is appropriate for most intellectual property (IP) related commercial disputes, and especially between parties from different jurisdictions. ADR can enhance the parties control over the dispute resolution process and, if well managed, it can save time and money. The WIPO Center offers ADR options to enable parties to efficiently settle their domestic or cross-border disputes.

WIPO ADR procedures are organized to stimulate positive opportunities for party settlement. Almost 70% of the mediation procedures administered by the WIPO Center have settled. Even in arbitration, 40% of WIPO cases settle before any formal decision is issued.

How to Submit a Dispute to WIPO Mediation?

Are you involved in a dispute?

• A party that wishes to propose submitting a dispute to WIPO Mediation may submit a request to the WIPO Center by email to arbiter.mail@wipo.int, and to the other party.
• The parties are free to determine where they want WIPO Mediation proceedings to take place.
• The WIPO Center can assist parties to identify suitable mediator candidates that satisfy the parties’ requirements (including from the Republic of Korea).

How much does WIPO Mediation cost?

Reduced administration and mediator’s fees apply to the cases referred to WIPO Mediation by KCC.

*To be paid after all parties agree to refer the dispute to WIPO Mediation. The filing of a Request for Mediation in accordance with Article 4 of the WIPO Mediation Rules is not subject to administration fees. If the parties agree to continue with the mediation process, the administration fee required by the WIPO Center's Schedule of Fees and Costs will be applicable.
