Relevant differences between the UDRP and the .BO Policy

Whereas in the UDRP the jurisdiction(s) where the trademark is valid is not considered relevant to panel assessment under the first element, under the .BO Policy the complainant needs to prove that the disputed domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights previously registered in Bolivia

Whereas in the UDRP a pending trademark application would not by itself establish trademark rights, under the .BO Policy a complainant may rely on a trademark previously applied for (i.e., pending registration) in Bolivia

It is sufficient for the complainant to prove that either registration or subsequent use of the domain name is in bad faith, whereas the UDRP requires the complainant to prove both elements

Registration of .BO domain names is unrestricted. Registration of domain names under the third level, such as “.com.bo”, “.net.bo”, “.org.bo” is unrestricted, but restrictions apply to domain names under “.gob.bo”, “.edu.bo”, “.mil.bo”, and “.int.bo”

  • - may have from 3 to 63 characters, including letters, numbers, and dashes;
  • - may not have dashes as the first or last characters of the domain name or two consecutive dashes;
  • - may not have spaces
