Disputes involving Personal Name Registrations
  • Subject to ERDRP and UDRP
  • For disputes concerning compliance with registration restrictions
  • Remedy: Transfer if complainant meets registration restrictions, otherwise opportunity to register a defensive registration

Disputes involving Phase I Defensive Registrations

  • Subject to ERDRP only
  • For disputes concerning compliance with registration restrictions regarding phase I defensive registrations
  • Remedies: (i) Cancellation of defensive registration; (ii) review of any other defensive registrations held by the respondent for compliance with registration restrictions; (iii) registration of personal name of complainant if complainant meets eligibility requirements; (iv) fee-refund for complainant

Disputes involving Phase II Defensive Registrations

Uniform Domain Name Dispute Resolution Policy

All registrants agree to be bound by the UDRP. The UDRP applies to challenges to registered domain names based on the grounds that:

(i) a domain name is identical or confusingly similar to a trademark in which the complainant has rights; and
(ii) the registrant has no rights or legitimate interests in respect of the domain name; and
(iii) the domain name has been registered and used in bad faith.
