Challenge Filing Guidelines

A Challenge must be submitted in hardcopy (with annexes) by postal or courier service and in electronic form (without annexes) via the Internet using the Online Challenge form provided by WIPO. The Center is not obliged to accept Challenges filed by other means. In case of technical problems, please print the completed form and send via fax to the WIPO Arbitration and Mediation Center +41 22 740 3700.

When the online Challenge form is submitted, a copy is sent automatically via the Internet to the e-mail address provided in the Challenge for the Respondent, the Registrar and RegistryPro. Furthermore, the Challenger receives an automatic confirmation message both on-screen and per e-mail to the address it has provided in the form. The confirmation message contains the full text of the Challenge as received by the Center. This text can be printed and used as the hardcopy to be submitted, together with attached trademark certificates, to the Center and the Respondent.

The hard copies must be sent as follows:

  • One signed original and two copies of the Challenge and all attachments by postal or courier service (postage pre-paid and return receipt requested) to:

  • One hard copy of the Challenge and all attachments by postal or courier service (postage pre-paid and return receipt requested) to the Respondent using the contact details provided in the RegistryPro .pro Whois database.

There is no need to send the Challenge to the Registrar or to the Registry.

The information to be included in the Challenge is described in Paragraph 3(c) of the Rules. The Challenge form contains specific fields for all elements to be included in the Challenge. The Challenger seeking transfer of the IP Defensive Registration must submit no later than 30 days of the commencement of the administrative proceeding an original or a certified copy of a trademark or service mark certificate demonstrating its compliance with the IP Defensive Registration Conditions (Paragraph 4(c) of the Policy, Paragraph 3(e) of the Rules). Copies must have been certified by the Trademark Office with which the trademark is registered. If any of the submitted certificates is in a language other than English, it must be accompanied by a certified translation into English.

All payments to be made in connection with IP Defensive Registration disputes shall be effected online by providing the necessary credit card information in the Online Challenge form. For further information about fees, see the Schedule of Fees and Paragraph 13 of the Rules.

A Response must be submitted in hardcopy (with annexes) by postal or courier service and in electronic form (without annexes) via the Internet using the Online Response form provided by WIPO. The Center is not obliged to accept Responses filed by other means.

When the online Response form is submitted, a copy is sent automatically via the Internet to the e-mail address provided in the Response for the Challenger. Furthermore, the Respondent receives an automatic confirmation message both on-screen and per e-mail to the address it has provided in the form. The confirmation message contains the full text of the Response as received by the Center. This text can be printed and used as the hardcopy to be submitted, together with attached trademark certificates, to the Center and the Challenger.

Together with the hard copy, the Respondent must submit an original or a certified copy of a trademark or service mark certificate demonstrating its compliance with the IP Defensive Registration Conditions (Paragraph 4(c) of the Policy, Paragraph 5(c)(i) and (ii) of the Rules). Copies must have been certified by the Trademark Office with which the trademark is registered. If any of the submitted certificates is in a language other than English, it must be accompanied by a certified translation into English.
