1. The Parties

The Complainant is Instagram, LLC, United States of America, represented by Hogan Lovells (Paris) LLP, France.

The Respondent is Instant Domains EEI, United Kingdom.

2. The Domain Name and Registrar

The disputed domain name <instagram.online> is registered with Alibaba.com Singapore E-Commerce Private Limited (the “Registrar”).

3. Procedural History

The Complaint was filed with the WIPO Arbitration and Mediation Center (the “Center”) on June 10, 2020. On June 11, 2020, the Center transmitted by email to the Registrar a request for registrar verification in connection with the disputed domain name. On June 12, 2020, the Registrar transmitted by email to the Center its verification response disclosing registrant and contact information for the disputed domain name which differed from the named Respondent and contact information in the Complaint. The Center sent an email communication to the Complainant on June 14, 2020 providing the registrant and contact information disclosed by the Registrar, and inviting the Complainant to submit an amendment to the Complaint. The Complainant filed an amended Complaint on June 18, 2020.

The Center verified that the Complaint together with the amended Complaint satisfied the formal requirements of the Uniform Domain Name Dispute Resolution Policy (the “Policy” or “UDRP”), the Rules for Uniform Domain Name Dispute Resolution Policy (the “Rules”), and the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy (the “Supplemental Rules”).

In accordance with the Rules, paragraphs 2 and 4, the Center formally notified the Respondent of the Complaint, and the proceeding commenced on June 22, 2020. In accordance with the Rules, paragraph 5, the due date for Response was July 12, 2020.

On June 23, 2020, the Respondent sent an email communication to the Complainant agreeing to surrender the disputed domain name to the Complainant, without condition (save that the Parties would bear their own costs).

On June 25, 2020, the Complainant declined the Respondent’s offer and indicated that, as it had already incurred the time and costs of filing a Complaint, it would prefer to wait for the Panel’s Decision. On July 12, 2020, the Respondent sent an email communication to the Center containing its Response and simultaneously requesting an extension of the Response due date. Pursuant to paragraph 5(b) of the Rules, the Response due date was extended to July 16, 2020. The Respondent did not submit any further documents.

The Center notified the Parties on July 20, 2020, that it would proceed to appoint the Administrative Panel.

The Center appointed Sebastian M.W. Hughes as the sole panelist in this matter on July 27, 2020. The Panel finds that it was properly constituted. The Panel has submitted the Statement of Acceptance and Declaration of Impartiality and Independence, as required by the Center to ensure compliance with the Rules, paragraph 7.

4. Consent to Transfer

The Respondent confirmed in its Response its consent to the transfer of the disputed domain name to the Complainant. The Panel considers, in the circumstances, it is appropriate to order transfer of the disputed domain name solely on the basis of such consent (see WIPO Overview of WIPO Panel Views on Selected UDRP Questions, Third Edition (“WIPO Overview 3.0”), section 4.10).

5. Decision

For the foregoing reasons, in accordance with paragraphs 4(i) of the Policy and 15 of the Rules, the Panel orders that the disputed domain name <instagram.online> be transferred to the Complainant.
