WIPO Arbitration Workshop - the Faculty

Trevor COOK, a national of the United Kingdom, is a partner with Bird & Bird in London. He is a member of the firm’s Intellectual Property Group. Mr. Cook is a solicitor and holds a degree in chemistry from the University of Southampton.

Mr. Cook has extensive experience in multi-jurisdiction patent litigation. He is on the WIPO List of Arbitrators and has acted as counsel and arbitrator in various arbitration cases. He has recently acted as arbitrator in a complex international WIPO patent arbitration.

Mr. Cook is the President of the UK Group of the International Association for the Protection of Industrial Property (AIPPI), Secretary to the British Copyright Council Standing Committee on Copyright and Technology, and a member of the Council of the Intellectual Property Institute.

Mr. Cook has authored several books and articles especially on patent issues, in particular The Protection of Regulatory Data in the Pharmaceutical and Other Sectors (Sweet & Maxwell 2000) and A User’s Guide to Patents (Butterworths 2002, Tottel - 2006) and Pharmaceuticals Biotechnology and the Law (Macmillan 1991, LexisNexis Butterworths 2009).

M. Scott DONAHEY, a national of the United States of America, based in Palo Alto, California, arbitrates and mediates disputes both nationally and internationally, having sat as an arbitrator and mediator in more than 300 cases. He has acted as arbitrator in arbitrations involving a genomic database joint development contract, a coronary stent patent, a software distribution agreement in China, a patent for a balloon catheter, a patent concerning the use of single molecule Raman spectroscopy for Direct DNA sequencing and of patents concerning the use of a “nanolens” to directly identify each individual sub-unit in a single strand of DNA as the sub-unit is encountered, a dispute involving a total knee replacement medical device, a research and development agreement for investment in the development of medical devices, a dispute concerning a license of patented genetic traits related to agricultural products, a distribution agreement concerning patented technology for a drug-eluting stent, dispute between manufacturer and distributor of DRAM components and modules, disputes between the Internet Corporation for Assigned Names and Numbers (ICANN) and domain name registries, and Japanese patents on pharmaceutical products, among others. He has also acted as sole appellate arbitrator in the appeal of a three person panel award concerning the licensing of a patented monoclonal antibody. Mr. Donahey has acted as counsel in arbitrations involving a license for a monoclonal antibody assay patent, a contact lens chemical composition patent, and an automated sera analyzer. He has acted as a mediator in cases involving Internet technology, pharmaceutical distribution agreements, and trademark cases in the apparel and entertainment industries. He has decided more than 350 domain name cases, applying principles of trademark law in the analyses. He is on the panels of Arbitrators and Mediators of the World Intellectual Property Organization (“WIPO”), the CPR Institute Technology Panel, Biotechnology Panel, Patent Panel, and Trademark Panel, the International Centre for Dispute Resolution, the American Arbitration Association Technology Panel, Trademark Panel, and Patent Panel, and many other national and regional panels around the world. He is on numerous domain name panels, including those of the WIPO, the Asian Domain Name Dispute Resolution Centre, and the China Internet Network Information Center.

In 1999, Mr. Donahey received the President's Award from the National Patent Board for Outstanding Service in the field of ADR. He was named as a SuperLawyer in the field of ADR seven consecutive years. Mr. Donahey is a mediator for the Northern District of California Federal District Court and for the First Appellate District of the State of California. He also serves as Adjunct Professor at the Santa Clara University School of Law, and the Golden Gate University School of Law, where he teaches courses in Law & Technology, and in International Dispute Resolution.

Mr. Donahey has a J.D. from Santa Clara University, summa cum laude, an M.A. from the Johns Hopkins University, and a B.A. from Stanford University, with distinction.

Christopher A. HUGHES,, a national of the United States, is a Partner at Cadwalader, Wickersham & Taft LLP in New York City. He is Chair of Cadwalader's Intellectual Property Litigation and Practice Group, and has over 30 years experience in complex patent, trade secret and trademark litigation, counseling, licensing, due diligence and anticounterfeiting matters. He has represented major clients in patent and trade secret trials and proceedings (jury and bench) in federal court, in the ITC, in state court and in WIPO arbitrations.

He has had numerous articles published worldwide and lectured on significant intellectual property issues in the U.S., Japan, Korea and China. He has authored several amicus briefs filed in the Federal Circuit Court of Appeals and in the U.S. Supreme Court and he has served as Special Master in patent matters, and he is a neutral arbitrator for WIPO. Internationally, he coordinates patent infringement trials and nullity hearings throughout Europe and opposition proceedings on important patent rights in the EPO.

Chris is Past President of the NYIPLA (2007-08) and has been consistently recognized by such peer-review publications as "Chambers," "Best Lawyers," "Benchmark Litigation," "Super Lawyers" and has been ranked as one of the Top-10 IP Lawyers in the U.S. by UnitedStatesLawyerRankings.com.

David PERKINS, a national of the United Kingdom, is a partner in Arnold & Porter (UK), LLP’s intellectual property practice in London. Prior to joining the firm, he served in major leadership positions in the intellectual property practice area at international law firms. He was a partner at Clifford Chance from 1975 to 2003 in which he headed its European intellectual property litigation practice and subsequently at Milbank Tweed’s London office from 2003 to 2009.

Mr. Perkins concentrates his practice on multijurisdictional patent litigation, as well as trademark and antitrust issues. He also handles oppositions and appeals before the European Patent Office in Munich and references to the European Court of Justice (ECJ) in Luxembourg. He also acts as counsel and arbitrator in numerous arbitrations involving intellectual property rights.

Mr. Perkins is also an Arbitrator and Mediator for the World Intellectual Property Organization’s Domain Name Dispute Resolution Service. He has had significant involvement in advising in relation to both mediation and arbitration of multi-jurisdictional disputes involving intellectual property rights.

Mr. Perkins is a member of several professional bodies including the Law Society, the International Bar Association (IBA), and the European Communities Trade Mark Association (ECTA), the International Association for the Protection of Intellectual Property (AIPPI) and an Associate Member of the Chartered Institute of Patent Agents (CIPA). He is a foreign member of the American Bar Association (ABA) and the American Intellectual Property Law Association (AIPLA). He is a Council Member of the Intellectual Property Institute (IPI), and of the Intellectual Property Lawyers Organisation (TIPLO), of which he is also a founding member. He is a member of the Executive Committee of the European Union of Intellectual Property Practitioners (UNION) and a Council Member of the British Group of UNION. He also served as a member of the UK Government's Intellectual Property Advisory Committee (IPAC) from August 2001 to April 2005.

Mr. Perkins has written over 50 publications. He studied Law at Newcastle University.

Lucy F. REED, a national of the United States of America, is a Partner with Freshfields Bruckhaus Deringer US LLP in New York. She is co-head of the Freshfields Global International Arbitration Group.

A specialist in international commercial arbitration, Ms. Reed advises private and public clients and serves as arbitrator in arbitrations under the major institutional and ad hoc rules. She is also an arbitrator on the Eritrea-Ethiopia Claims Commission, and served as a co-director of the Claims Resolution Tribunal for Dormant Accounts in Switzerland. She has written and lectured extensively on international arbitration, and is a co-author of The Freshfields Guide to Arbitration and ADR: Clauses in International Contracts, and Guide to ICSID Arbitration (both published by Kluwer).

She was the first general counsel of the Korean Peninsula Energy Development Organization. She was with the US State Department as the US agent to the Iran-US Claims Tribunal, and Deputy Assistant Legal Adviser for International Claims and Investment Disputes.

Ms. Reed is Chair for the Institute of Transnational Arbitration, immediate past President of the American Society of International law, and a member of the Council on Foreign Relations.

Ms. Reed received her BA from Brown University in 1974 and her law degree from the University of Chicago Law School in 1977, where she was a member of the Law Review.

Her recent experience includes representing: ConocoPhillips in its ICSID case against the Government of Venezuela; the Government of Turkey in three Energy Charter Treaty cases; an Asian government entity in ICC arbitrations involving a disputed share purchase agreement; a US energy company in LCIA arbitrations based on political risk insurance claims; CMS Energy in the first ICSID arbitration against Argentina to succeed on the merits and jurisdiction; and Japanese companies in arbitrations of licensing disputes.
