Description
The purpose of the WIPO Mediation Workshop is to provide training for parties in mediation and mediators, with focus on specific mediation techniques and on the role of the mediator as a neutral, independent and impartial intermediary between the parties. The Workshop will include a general presentation of the 2014 WIPO Mediation Rules, as well as interactive sessions about the different steps in mediation and the mediator’s techniques.
The format of the Workshop will consist of presentations by the instructors and discussion between participants and instructors. After completion of the Workshop, participants will have a better understanding of the procedural steps of mediation, as well as the benefits of mediation in intellectual property disputes as compared to other dispute resolution options, in particular arbitration and court litigation. In addition, they will obtain practical information about the role of the WIPO Center in ADR proceedings, and its mediation clauses and rules.
Program
The Program of the WIPO Mediation Workshop will be devoted to the following subjects:
- Drafting Mediation Clauses, including for FRAND Disputes
- Preparation for and Commencement of a Mediation
- Selection and Appointment of Mediators
- Organization and Conduct of a Mediation
- Role of the Different Actors in a Mediation
- Conclusion of a Mediation
- Case Management Techniques for Intellectual Property Mediation
Faculty
The faculty for this Workshop will consist of experienced WIPO mediators with extensive international mediation experience, including exposure to intellectual property, technology issues, and entertainment transactions.

Who Should Attend
The WIPO Mediation Workshop is designed for lawyers, patent and trademark attorneys, and others wishing to familiarize themselves with the international mediation processes and to receive training as party representatives or mediators. Proficiency in English is essential for participation.
Certificate of Participation (including for CLE/CPD)
All participants who complete the program will be awarded a certificate of participation. Those who have applied for Continuing Legal Education (CLE) or Continuing Professional Development (CPD) credit will receive a special certificate to this effect.
