Disputes arising from the licensing of standard essential patents (SEPs) has been an increasingly important area of dispute resolution. SEP licensing on fair, reasonable and non-discriminatory (FRAND) terms has been a contentious issue with numerous high-profile cases being pursued in national courts around the world, including China, Germany, India, the UK and the US. The high profile nature of the disputes and the economic importance of effective SEP licensing has prompted extensive industry discussion as well as government interest and policy proposals, such as the recently released draft EU SEP Proposal.
The panel will discuss the current state of SEP and FRAND licensing and the role of ADR in such licensing disputes and negotiations.

- Ignacio de Castro, Director of the IP Disputes and External Relation Division of the WIPO Arbitration and Mediation Center. Before joining WIPO in 2002, he practiced with the law firms Baker & McKenzie, London and Freshfields Bruckhaus Deringer, London in the areas of international arbitration and litigation.
- Chung Nian Lam, Head of the Intellectual Property, Technology & Data Group at WongPartnership LLP, a leading Singapore law firm. He has extensive experience representing multinational companies, listed corporations and government clients on regulatory, transactional, enforcement and advisory matters.
- Morag McDonald, partner at Bird & Bird in London. Morag is experienced in all forms of IP litigation and strategic advice, especially in an international cross border context.
- Naoki Yoshida, managing partner of Finnegan’s Tokyo office. Naoki handles a broad range of intellectual property matters, including litigation, patent portfolio management, intellectual property due diligence, client counseling, licensing and negotiations, patent prosecution, and pre-litigation strategic counseling.
