Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication of the Government of the United States of America Regarding Changes in the List of Kinds of Microorganisms Accepted for Deposit and in the Schedule of Fees of the Provasoli-Guillard National Center for Marine Algae and Microbiota (NCMA)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify the receipt from the Government of the United States of America, on January 3, 2019, of a written communication related to changes in list of the kinds of microorganisms accepted for Deposit and in the Schedule of Fees of the Provasoli-Guillard National Center for Marine Algae and Microbiota (NCMA), an International Depositary Authority (IDA) under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, and amended on September 26, 1980 (see Budapest Notification No. 293 of April 26, 2013).

Text of the communication of the Government of the United States of America dated December 21, 2018, relating to the Changes in the List of Kinds of Microorganisms Accepted for Deposit and in the Schedule of Fees of the Provasoli-Guillard National Center for Marine Algae and Microbiota (NCMA)

COMMUNICATION

As required by Rules 3.3 and 12.2 of the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure (Budapest Treaty), we are writing to notify you of changes to the kinds of biological materials the NCMA will accept for deposit and its fees as an International Depositary Authority (IDA). The current NCMA list of microorganisms which may be deposited and schedule of fees published in the "Guide to the Deposit of Microorganisms under the Budapest Treaty" for this institution should be replaced with the list and fee schedule below.  The NCMA would like these changes to go into effect as soon as possible.

1(a) Types of Biological Material that May Be Deposited

Any algae (including single-celled microalgae and multicellular algae), eukaryotic protists, bacteria, archaea, or viruses from any aquatic environments (including freshwater, brackish, marine and hyper-saline), plant tissue cultures (terrestrial or aquatic) and seeds, and bacteria and fungi from terrestrial environments.
