Notifications

Date: December 12, 2019

The Japanese Patent Office (JPO) notified the International Bureau, in accordance with paragraphs 10 and 12 of the Framework Provisions of the Digital Access Service, that it would extend the scope of the World Intellectual Property Organization (WIPO Digital Access Service (DAS) digital library to JPO Industrial Designs, as of January 1, 2020.  

In addition, the JPO will adopt the following technical and operational options on and after January 1, 2020:

  • Communications between the JPO and the International Bureau (IB) of WIPO will be based on the Trilateral Document Access (TDA) Specifications, with the exceptions of large-size data, which continue to be delivered to and from the IB on CD or DVD.
  • The JPO, as a depositing office, will deposit certified copies of patent, utility model and industrial design applications as priority documents via DAS in response to requests from accessing offices.
  • The JPO will continue not to deposit certified copies of international applications that are based on the Patent Cooperation Treaty (PCT) and filed to the JPO as the receiving Office via DAS.
  • The JPO, as an accessing office, will retrieve certified copies of patent, utility model and industrial design applications that can be deposited in DAS by the corresponding depositing offices, as priority documents for patent, utility model and ind ustrial design applications. The exceptions to this will be priority documents for international applications that are based on the PCT and which entered the national phase in Japan.
  • In case patent and utility model applications are filed with the JPO as an accessing office, and if the priority documents deposited by depositing offices are color or greyscale data, the JPO will request DAS to send them after being converted into black and white data. At the same time, in case industrial design applications are filed with the JPO as an accessing office, the JPO will retrieve any of color, greyscale, and black and white data of priority documents as deposited by depositing Offices, without any conversion in DAS.

Date: March 4, 2013

The Japan Patent Office notified the International Bureau that as from March 17, 2013, and in accordance with paragraph 10 and 12 of the modified Framework Provisions that came into effect on July 1, 2012, the JPO will deposit and retrieve priority documents according to the 'New Route', both as a depositing office and an accessing office. In addition the following technical and operational options will take effect as from March 17, 2013:

  • Communications between the JPO and the International Bureau (IB) of WIPO will be based on the Trilateral Document Access (TDA) Specifications, with the exceptions of large-size data, which will continue to be delivered to and from the IB on CD or DVD.
  • The JPO, as a depositing office, will deposit certified copies of patent and utility model applications as priority documents via DAS in response to requests from accessing offices.
  • The JPO will not deposit certified copies of international applications that are based on the Patent Cooperation Treaty (PCT) and filed to the JPO as the receiving Office via DAS.
  • The JPO, as an accessing office, will retrieve certified copies of patent, utility model and design applications that can be deposited in DAS by the corresponding depositing offices, as priority documents for patent and utility model applications. The exceptions to this will be priority documents for international applications that are based on the PCT and which entered the national phase in Japan.
  • If priority documents deposited by depositing offices are color or greyscale data, the JPO, as an accessing office, will request DAS to send them after being converted into black and white data.

The Japan Patent Office notified the International Bureau in accordance with paragraphs 10 and 12 of the modified Framework Provisions, that it would modify its operation as both depositing office and accessing office with effect from July 1, 2012 as follows:

  • As a depositing office, the JPO will deposit priority documents of patent and utility model applications in response to a request from an accessing office via DAS.
  • As an accessing office, the JPO will retrieve priority documents of patent, utility model or design applications which can be deposited in DAS by corresponding depositing offices, as priority documents for patent and utility model applications.

Date: March 6, 2009

The Japan Patent Office notified the International Bureau in accordance with paragraph 10 and 12 of the Framework Provisions that it would commence operation as both a depositing Office and an accessing Office with effect from 1 April 2009.

In respect of this notification, the Office specified the following options:

  • Communication beween the International Bureau and the Office would comply with the Trilateral Document Access specification, including the provisions relating to Priority Document eXchange and DAS services, as well as the sending of oversized documents on CD or DVD.
  • As a depositing Office, the Office has adopted Route C from the entry routes set out in the system architecture.
