Provisions of Law

Article 147. Violation of Inventor's Rights and Patent Rights

1. Illegal use of an invention, utility model or industrial design, disclosure of the essence of an invention, utility model or industrial design without the consent of its author or an applicant prior to the official publication of the relevant information, usurpation or coercion to co-authorship if these actions caused major (significant) damage, shall be punished with a fine in amount of up to 200 thousand rubles, or in amount of a wage/salary or any other income of the convicted person for a period of up to 18 months, or by obligatory labour for a term of up to four hundred and eighty hours, or by compulsory works for a term of up to two years, or by imprisonment for the same term.

2. The same actions when committed by a group of persons by previous concert or by an organized group, shall be punished with a fine in amount from 100 thousand to 300 thousand rubles, or in amount of a wage/salary or any other income of the convicted person for a period from one year to two years, or by compulsory works for a term of up to five years, or by arrest for a term of up to six months, or by imprisonment for the term of up to five years.
