The metaverse enables us to participate through avatars in a range of virtual activities such as football matches, music concerts and fashion shows, many of which involve trademarks. Some trademark holders have already sought trademark registration to prevent the unauthorized use of their marks in the metaverse. Nevertheless, goods bearing counterfeit trademarks are openly traded and used in the metaverse via Non-Fungible Tokens (NFTs). The NFT market is already flooded with counterfeits, leaving both trademark owners and NFT consumers confused and discontent. Some are calling for large NFT markets to better police their operations through voluntary best practices.||This webinar looks at the trade of virtual goods bearing counterfeit trademarks in the metaverse, the main trademark disputes that have arisen in the framework of the metaverse so far and the solutions that have been identified to effectively enforce trademarks in this fast-developing virtual space.

In this session, we will be discussing civil remedies available for trade secret misappropriation. Given that the value of a trade secret disappears or diminishes significantly through misappropriation, civil remedies are crucial. This webinar will lay out the different stages of a civil proceeding, focusing on the different enforcement strategies that the owner of a trade secret can take to prevent misappropriation and to receive appropriate compensation for damages suffered. The session will also address enforcement challenges that are unique to trade secret litigation, as well as strategies for preventing misappropriation.

In this session, the authors of the WIPO-commissioned study on “Copyright Infringement in the Video Game Industry” will discuss the variety of threats faced by video game developers from potential copyright infringement, especially when the video game is commercially successful. These threats can originate from competitors, players and third parties in general, intending to use the work without authorization or beyond the terms of the license. Some threats are similar to those in other creative industries, such as piracy, but others are specific and often unique to video games (e.g., key and account selling). This webinar will introduce stream ripping (the obtaining of a permanent copy of a content that is streamed online) and its relationship with music piracy. The session will address how stream ripping infringes copyright and the economic impact it causes to the recorded music industry. Furthermore, we will explore how courts have ruled on copyright infringement in cases involving stream ripping and have awarded damages. This webinar will address the role of customs authorities and border measures in the effective enforcement of intellectual property rights (IPRs). IPR infringing goods, and especially counterfeit trademark and pirated copyright goods, harm the economy of the country of destination and threaten the health, security and safety of its population. The detection of IPR infringing goods originating from abroad, and suspending their release into free circulation at the point of entry is therefore crucial. The session will also present IP border enforcement from an international perspective, specifically focusing on international cooperation among customs authorities.
