Sweden: Trade Names Act (1974:156)

Sweden: The 2016 consolidated version of the Trade Names Act (1974:156) incorporates the amendments introduced by the Act (2016:373) Amending the Trade Names Act (1974:156), which came into force on June 1, 2016, and the Act (2016:197) Amending the Trade Names Act (1974:156), which came into force on September 1, 2016.

These Acts provide for amendments relating, inter alia, to the: (i) requirements for and obstacles to registration of a trade name; (ii) imposition of liquidated damages for trade name infringement together with the injunctions as the existing remedy therefor; and (iii) competence of a new court named the Patent and Market Court, which handles trade name infringement cases and cancellation cases of registration of tradenames, as well as appeals following decisions taken by the Patent and Registration Office.
