Sweden: Trademarks Act (2010:1877)

Sweden: The 2016 consolidated version of the Trademarks Act (2010:1877) incorporates the amendments made up to Act (2016:228) Amending the Trademarks Act (2010:1877) and Act (2016:375) Amending the Act (2016:228) Amending the Trademarks Act (2010:1877), which come into force on September 1, 2016.
These Acts provide for the amendments relating, inter alia, to the: (i) requirements for and obstacles to registration of a trademark; (ii) change of the wording from "Council Regulation (EC) No. 207/2009" to "Council Regulation (EU) No. 2015/2424" in the provisions on Community Trademarks, as referred to in the Trademarks Act; (iii) imposition of liquidated damages for trademarks infringement together with the injunctions as the existing remedy therefor; and (iv) competence of a new court named the Patent and Market Court, which handles trademark infringement cases and administrative cancellation cases of registration of trademarks (including community trademarks), as well as appeals following decisions taken by the Patent and Registration Office.
