France: The Decree No. 2017-253 of February 27, 2017, on the Exception to Copyright, Related Rights and the Rights of Database Producers for People with Disabilities was published in the Official Gazette on February 28, 2017, and entered into force on March 1, 2017.
The Decree implements paragraph 7 of Article L. 122-5, Articles L. 122-5-1 and L. 122-5-2 of the Legislative Part of the Intellectual Property Code, and introduces amendments to Section 3 of Chapter II, Title II, Book I of the Regulatory Part of the Code.
It specifies, inter alia: (i) the conditions of eligibility of legal entities and establishments open to the public, which publish documents for disabled persons; (ii) the requirements for the grant and withdrawal of accreditation as well as the structure and functions of the commission in charge of disability exception in copyright, placed under the Minister for Culture and the Minister for Disabled Persons; and (iii) the measures for the French National Library to organize its activity in its capacity as depository of documents in digital format created by such accredited legal entities and establishments.
