Mexico: The Decree on Amendments and Additions to a Number of Provisions of the Industrial Property Law was published in the Official Journal of the Federation on March 13, 2018, and entered into force on April 27, 2018.
This Decree amends the Law on Industrial Property relating to the following inter alia: (i) establishing a legal protection regime for Geographical Indications in addition to Appellations of Origin; (ii) imposing criminal penalties for a number of claims concerning the unauthorized use of Geographical Indications and Appellations of Origins which are not in conformity with the Mexican Official Standards (NOMs); and (iii) extending the period of protection for industrial designs to 25 years and introducing the standard of novelty required to obtain industrial design protection.
