Luxembourg: The Law of April 25, 2018, on the Collective Management of Copyright and Related Rights and the Multi-Territorial Licensing of Rights in Musical Works for Online Use in the Internal Market, and on the Amendments to the Law of April 18, 2001, on Copyright and Related Rights and Databases entered into force on April 29, 2018.
The law lays down the requirements necessary to ensure the proper functioning of the management of copyright and related rights by collective management organizations ("CMOs") and the requirements for multi-territorial licensing by the CMOs of authors' rights in musical works for online use, in accordance with Directive 2014/26/EU of the European Parliament and of the Council of 26 February 2014.
The Law further amends the Law of April 18, 2001, on Copyright and Related Rights and Databases. The amendments refer to the appointment of a Commissioner for copyright and related rights (a member of the Commission of Copyright and Related Rights attached to the Minister of Economy) and permit duly authorized CMOs only to transmit the cable broadcasts.
