Canada: Industrial Design Regulations (SOR/2018-120)
November 5, 2018
Canada: The Industrial Design Regulations (SOR/2018-120) were adopted on June 12, 2018, and entered into force on November 5, 2018.
These Regulations repeal the Industrial Design Regulations (SOR/99-460) and make significant changes to Canada's industrial design regime, in order to implement the Geneva Act of the Hague Agreement, to which Canada became party on November 5, 2018.
The Regulations, inter alia, (i) increase the term of protection for industrial designs from 10 to 15 years; (ii) simplify the application and filing date requirements; and (iii) improve the e-filing interface for applicants, which includes enhanced functionalities and streamlined processes.
