United Kingdom: Intellectual Property (Copyright and Related Rights) (Amendment) (EU Exit) Regulations 2019 (S.I. 2019/605)

United Kingdom: The Intellectual Property (Copyright and Related Rights) (Amendment) (EU Exit) Regulations 2019 (S.I. 2019/605) were issued pursuant to section 8(1) and paragraph 21(b) of Schedule 7 to the European Union (Withdrawal) Act 2018 and were amended by the Intellectual Property (Amendment etc.) (EU Exit) Regulations 2020.
The Regulations entered into force on December 30, 2020, and apply from January 1, 2021, which inter alia, ensures that retained European Union law contains appropriate references, which does not presuppose the United Kingdom's membership in the European Union.
The Regulations amend the following legislation:
(i) Copyright and Related Rights (Marrakesh Treaty etc.) (Amendment) Regulations 2018 (S.I. 2018/995);
(ii) Council Regulation (EU) 2017/1563;
(iii) The Collective Management of Copyright (EU Directive) Regulations 2016 (S.I. 2016/221);
(iv) The Copyright and Performances (Application to Other Countries) Order 2016 (S.I. 2016/1219);
(vii) The Artist's Resale Right Regulations 2006 (S.I. 2006/346);
(viii) The Copyright and Rights in Databases Regulations 1997 (S.I. 1997/3032);
(ix) The Copyright and Related Rights Regulations 1996 (S.I. 1996/2967);
(x) The Duration of Copyright and Rights in Performances Regulations 1995 (S.I. 1995/3297); and
(xi) The Copyright, Designs and Patents Act 1988 (Chapter 48).
This legislation further repealed the Portability of Online Content Services Regulations 2018 (S.I. 2018/249) and Regulation (EU) 2017/1128 of the European Parliament and of the Council of 14 June 2017 on cross-border portability of online content services in the internal market.
