Administrative Instructions under the PCT (AI)
703(f) re. Section 703(b)(ii) to (iv) and relevant sections of Annex F of AI:

JP Japan Patent Office

  1. The Intellectual Property Office (Belgium) has withdrawn its notification of incompatibility with its national law under PCT Rules 20.8(a) and 26bis.3(j) as from 1 April 2018.
  2. The Swiss Federal Institute of Intellectual Property has withdrawn its notification of incompatibility with its national law under PCT Rule 23bis.2(e) as from 1 January 2019.
  3. The Norwegian Industrial Property Office has withdrawn its notification of incompatibility with its national law under PCT Rules 26bis.3(j), 49ter.1(g) and 49ter.2(h) as from 1 July 2019.
  4. The Canadian Intellectual Property Office has withdrawn its notification of incompatibility with its national law under PCT Rule 49ter.1(g) as from 30 October 2019 in respect of international applications having an international filing date on or after 30 October 2019.
  5. The Offices (in their capacity as receiving Offices) of the States listed in this table have notified the International Bureau (IB) that new PCT Rules 20.5bis(a)(ii) and 20.5bis(d), are not compatible and/or cannot be considered to be compatible with the national law applied by the Office, or are deemed to have notified the IB of this incompatibility on the basis of a notification made under PCT Rule 20.8(a) that remains in effect.
  6. The Offices (in their capacity as designated Offices) of the States listed in this table have notified the International Bureau (IB) that PCT Rules 20.5bis(a)(ii) and 20.5bis(d), are not compatible and/or cannot be considered to be compatible with the national law applied by the Office, or are deemed to have notified the IB of this incompatibility on the basis of a notification made under PCT Rule 20.8(b) that remains in effect.
  7. The Italian Patent and Trademark Office has withdrawn its notification of incompatibility with its national law under PCT Rule 20.8(a), ​which is also deemed to be extended to PCT Rule 20.8(a-bis), and under PCT Rule 26bis.3(j), as from 1 July 2020.
  8. The European Patent Office has withdrawn its notifications of incompatibility under PCT Rules 20.8(a-bis) and 20.8(b-bis) as from 1 November 2022.
  9. The China National Intellectual Property Administration (CNIPA) has withdrawn its notification of incompatibility with its national law under PCT Rules 20.8(b) and 20.8(b-bis) as from 20 January 2024, and the relevant PCT Rules will apply to international applications which enter its national phase on or after 20 January 2024.
  10. The China National Intellectual Property Administration (CNIPA) has withdrawn its notification of incompatibility with its national law under PCT Rules 49ter.1(g) and 49ter.2(h) as from 20 January 2024, and the relevant PCT Rules will apply to international applications in respect of which the two-month period from the date of entry into its national phase expires on or after 20 January 2024.
