By accessing/using the WIPO Account system, the User is agreeing to be bound by these Terms of Use.
In these Terms of Use:
“WIPO Account” or “WIPO Account system” refers to the WIPO system storing user profile information that is used to authenticate access to a range of WIPO’s online services.
“User” refers to any person who has created a WIPO Account.
2.1 The Account is a unique, personal account, and should be held by an individual User.
2.2 If the Account is used to represent a company, organization, author or owner of any Intellectual Property, the User certifies that they are authorized to do so.
2.3 The information provided during the creation of the Account and any subsequent edits to this information must be accurate and will be maintained as accurate by the User.
2.4 The User’s login information is personal and confidential. The User may not use the WIPO Account of any other person. The User may not disclose or share their access credentials (Username, Password, Strong Authentication details) with any other person. The User shall be responsible for any damages arising out of, or in connection with, the disclosure of their login information to any other person. The User agrees to notify WIPO immediately of any unauthorized use of their login information as soon as they are aware thereof. The User is also advised in such circumstances to change their password without delay.
2.5 The User is forbidden to use the WIPO Account system for any activity considered as unlawful in any jurisdiction and to perform any abusive use degrading or circumventing the system. The User must not distort, mutilate, modify or take other action in relation to any data made available via their use of the WIPO Account system that would be prejudicial to the reputation of WIPO or others.
2.6 WIPO reserves the right to revoke any WIPO Account at its sole discretion where it is deemed that the use of the Account does not comply with the current Terms of Use, or in the event that there has been a period of inactivity that indicates the Account is no longer in use.
2.7 Specific terms may apply to WIPO online services and data made accessible through use of the WIPO Account and the User agrees to comply with such terms when accessing these services and data.
3.1 Users may connect their WIPO Accounts via the connections mechanism. Once connections have been established between WIPO Accounts, Users may share access rights, or permissions, to data stored in WIPO systems.
3.2 The User shall assume sole responsibility for requesting, accepting and maintaining connections with other WIPO Account Users. It is the responsibility of the User to maintain the correct levels of access rights that they have granted to other Users with respect to their data, including, assignment, modification, and removal of access rights.
3.3 WIPO accepts no liability for any consequences resulting from a User sharing data with another User via the granting of access rights.
3.4 If a WIPO Account has dedicated access rights set up in respect of confidential data held in a specific WIPO online service, WIPO reserves the right to revoke access to that WIPO online service in the event that there has been a period of inactivity that indicates the Account is no longer in use.
4.1 Some WIPO systems and online services may require an additional authentication step (strong authentication) to be taken by the User in order to permit access.
4.2 Strong authentication mechanisms that may be associated with a WIPO Account include authenticator apps, SMS for one time password and supported digital certificates. Strong authentication mechanisms must be treated as securely as the User’s login information and must not be shared. It is recommended to set up at least two strong authentication mechanisms should one of them not be available for any reason.
5.1 WIPO takes all necessary measures to ensure maximum availability of the WIPO Account system 24 hours per day, 7 days per week. This service may however be unavailable from time to time for scheduled maintenance or due to unforeseen circumstances. Information about service unavailability or maintenance will be published on WIPO’s website when possible.
5.2 The WIPO Account system is serviced through an industry standard secured https:// protocol.
6.1 The User does not have the right to use the WIPO name, logo or acronym unless it is specifically authorized by WIPO in writing after having sent a request to WIPO.
6.2 The User recognizes that the WIPO Account, including the particular form of compiling data, the presentation and design of the WIPO Account, are protected by applicable IP laws.
7.1 The use of the WIPO Account system is at the sole responsibility of the User and WIPO shall not be liable for any consequences of the use of this system. WIPO shall not be liable for any direct, incidental, consequential, liquidated, special, punitive or exemplary damages or penalties to the User, including, but not limited to, losses of business, revenue or profits, as a consequence of using the WIPO Account system.
7.2 WIPO shall not be liable or deemed to be in default for any delays or failure in performance or interruption of the WIPO Account system resulting directly or indirectly from any cause or circumstance beyond its reasonable control.
The names and the designations used by WIPO on its website and online services do not imply the expression of any opinion whatsoever on the part of WIPO concerning the legal status of any country, territory, city or area.
The User acknowledges that WIPO may use their personal data according to WIPO’s Privacy Policy, which is incorporated herein by this reference.
WIPO may amend these Terms of Use at any time at its sole discretion. Any amendments will be posted on this page. Unless stated otherwise, amendments shall take effect immediately following posting of the new Terms of Use.
Nothing in or relating to these Terms of Use shall be deemed or interpreted as a waiver of any privileges and immunities accorded to WIPO as an international organization and specialized agency of the United Nations.
12.1 Any dispute between WIPO and the User arising out of or relating to these Terms of Use that cannot be resolved amicably shall be referred to arbitration in accordance with the UNCITRAL Arbitration Rules then in force. The parties shall be bound by any arbitration award rendered as a result of such arbitration as the final adjudication of such a dispute.
12.2 WIPO shall not have any responsibility, obligation or liability whatsoever with respect to any disputes between the User and a third party, including any other User, that may arise in relation to the use of the WIPO Account system.
