Subject Matter of Protection
Article 4
This Ordinance-law shall protect the copyright in all works of the mind, regardless of the genre, form of expression, merit or purpose.
The following in particular shall be considered works of the mind:
- (n) folklore;
- (o) works derived from folklore.
Article 6
Under the terms of this Ordinance-Law, the phrases below shall mean the following:
(k) folklore: artistic, literary or scientific work passed from generation to generation and constituting one of the basic elements of the Generalcultural heritage;
(l) work derived from folklore: work composed of elements borrowed from the Generalcultural heritage.
Beneficiaries or Rightholders
Article 14
The copyright in folklore shall belong to the State, which shall exercise it under the arrangements laid down by the President of the Republic.
Article 15
The copyright in a work inspired by folklore shall belong to the person who created it.
