WIPO’s IP Benchbook Series available online to guide judges through IP adjudication
July 3, 2023
WIPO’s publication of the new Intellectual Property Benchbook Series makes available a unique resource for judges in navigating the specificities of intellectual property (IP) adjudication and case management.
The Benchbook series is a set of practical manuals on IP law and procedure to support judges in adjudicating IP cases appearing before them in their own courts, as well as for readers interested in learning about judicial adjudication of IP disputes across jurisdictions.
The first volume of the series, Introduction to the International IP Legal Framework, shares WIPO’s expertise and global perspective on the multilateral treaties that shape IP law in the areas of trademark, patent, copyright, and remedies.
The following volumes each cover a national jurisdiction, beginning with titles addressing IP Adjudication in the Philippines and IP Adjudication in Viet Nam. These national volumes are authored by experienced judicial contributors from each country, with support from the Federal Court of Australia, to provide practical guidance for their peers on issues arising at all stages of adjudication of trademark, patent and copyright cases, including practical tips drawn from the authors’ experience. The series will continue to expand, with further national and regional volumes in preparation.
The volumes feature direct links to the full text of referenced international treaties, national legislative and procedural provisions, as well as significant jurisprudence, all available via the WIPO Lex database.
The Benchbook series was conceived by the WIPO Judicial Institute in response to requests for tools and resources for national judiciaries, particularly on the procedural aspects of IP adjudication, and is a part of the Institute’s efforts to build sustainable, long-term judicial education programs.
