《2017年集成電路的布圖設計 (拓樸圖 ) (合資格國家、 領域或地方的指定 ) (修訂 )規例》
(由行政長官在徵詢行政會議的意見後根據《集成電路的布圖設計 (拓 樸圖 )條例》(第 445章 )第 24條訂立 )
1. 生效日期 本規例自 2017年 4月 1日起實施。
2. 修訂《集成電路的布圖設計 (拓樸圖 ) (合資格國家、領域或 地方的指定 )規例》 《集成電路的布圖設計 (拓樸圖 ) (合資格國家、領域或地方 的指定 )規例》(第 445章，附屬法例 B)現予修訂，修訂方式 列於第 3條。
3. 修訂附表 (合資格國家、領域或地方 ) (1) 附表，在“阿爾巴尼亞共和國”項目之前——
加入 “阿富汗伊斯蘭共和國”。
(2) 附表，在“柬埔寨王國”項目之前—— 加入 “哈薩克斯坦共和國”。
(3) 附表，在“希臘共和國 (希臘 )”項目之前——

consultation with the Executive Council)
1. Commencement
This Regulation comes into operation on 1 April 2017.
2. Layout-design (Topography) of Integrated Circuits (Designation of Qualifying Countries, Territories or Areas) Regulation amended
The Layout-design (Topography) of Integrated Circuits (Designation of Qualifying Countries, Territories or Areas) Regulation (Cap. 445 sub. leg. B) is amended as set out in section 3.
3. Schedule amended (qualifying countries, territories or areas)
(1) The Schedule, before item “The Republic of Albania”—
Add
“The Islamic Republic of Afghanistan”.
(2) The Schedule, before item “The Republic of Kenya”—
Add
“The Republic of Kazakhstan”.
(3) The Schedule, before item “The Principality of Liechtenstein”—

Explanatory Note Paragraph 1
Explanatory Note
As a member of the World Trade Organization (WTO), Hong Kong is obliged to grant the same level of intellectual property protection for layout-designs (topographies) of integrated circuits to nationals of other WTO member countries, territories or areas as to Hong Kong residents.
2. Afghanistan, Kazakhstan, Liberia and Seychelles have acceded to the World Trade Organization Agreement. This Regulation updates the list of qualifying countries, territories or areas contained in the Layout-design (Topography) of Integrated Circuits (Designation of Qualifying Countries, Territories or Areas) Regulation (Cap. 445 sub. leg. B) to include them.
註釋
作為世界貿易組織成員，香港須向其他成員國、地區或地方 的國民，就集成電路布圖設計 (拓樸圖 )，提供知識產權保護， 而該項保護，須達到香港居民所獲保護的水平。
2. 阿富汗、哈薩克斯坦、利比里亞及塞舌爾已加入《世界貿易 組織協議》。本規例更新《集成電路的布圖設計 (拓樸圖 ) (合 資格國家、領域或地方的指定 )規例》(第 445章，附屬法例 B) 所載的合資格國家、領域或地方列表，以納入該等國家。
