Regulations Amending the Definition of Local Signal and Distant Signal Regulations and the Definition of “Small Cable Transmission System” Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Industry, pursuant to paragraph 31(3)(a) (see footnote a) and subsection 68.1(5) (see footnote b) of the Copyright Act (see footnote c), makes the annexed Regulations Amending the Definition of Local Signal and Distant Signal Regulations and the Definition of “Small Cable Transmission System” Regulations.
REGULATIONS AMENDING THE DEFINITION OF LOCAL SIGNAL AND DISTANT SIGNAL REGULATIONS AND THE DEFINITION OF “SMALL CABLE
TRANSMISSION SYSTEM” REGULATIONS
DEFINITION OF LOCAL SIGNAL AND DISTANT SIGNAL REGULATIONS 1. Paragraph 1(a) of the Definition of Local Signal and Distant Signal Regulations (see
footnote 1)is replaced by the following:
(a) in respect of a terrestrial television station (i) for an analog signal, the area within the predicted Grade B contour of the station, as determined in accordance with the method set out in the schedule, and the area within a radius of 32 km from that contour, and (ii) for a digital signal, the area within the noise-limited bounding contour of the station, as determined in accordance with the document entitled BPR-10 — Application Procedures and Rules for Digital Television (DTV) Undertakings, Issue 1, published by the Department of Industry in August 2010, and the area within a radius of 32 km from that contour;
DEFINITION OF “SMALL CABLE TRANSMISSION SYSTEM” REGULATIONS 2. Subsection 3(2) of the French version of the Definition of “Small Cable Transmission
System” Regulations (see footnote 2) is amended by replacing “câble” with “fil”.
COMING INTO FORCE 3. These Regulations come into force on the day on which they are published in the Canada
Gazette, Part II.

Sur recommandation du ministre de l’Industrie et en vertu de l’alinéa 31(3)a) (voir référence a) et du paragraphe 68.1(5) (voir référence b) de la Loi sur le droit d’auteur (voir référence c), Son Excellence le Gouverneur général en conseil prend le Règlement modifiant le Règlement sur la définition de signal local et de signal éloigné et le Règlement sur la définition de « petit système de transmission par fil », ci-après.
RÈGLEMENT MODIFIANT LE RÈGLEMENT SUR LA DÉFINITION DE SIGNAL LOCAL ET DE SIGNAL ÉLOIGNÉ ET LE RÈGLEMENT SUR LA DÉFINITION DE
« PETIT SYSTÈME DE TRANSMISSION PAR FIL »
RÈGLEMENT SUR LA DÉFINITION DE SIGNAL LOCAL ET DE SIGNAL ÉLOIGNÉ
1. L’alinéa 1a) du Règlement sur la définition de signal local et de signal éloigné (voir référence 1) est remplacé par ce qui suit :
a) dans le cas d’une station terrestre de télévision : (i) à l’égard de signaux analogiques, de l’aire comprise à l’intérieur du périmètre de rayonnement prévu de classe B de la station, déterminé conformément à la méthode prévue à l’annexe, et dans un rayon de 32 km de ce périmètre, (ii) à l’égard de signaux numériques, de l’aire comprise à l’intérieur du périmètre de rayonnement limité par le bruit de la station, déterminé conformément à l’établissement du contour limité par le bruit selon le document intitulé RPR-10 — Règles et procédures de demande relatives aux entreprises de télévision numérique (TVN), 1 édition, publié par le ministère de l’Industrie en août 2010, et dans un rayon de 32 km de ce périmètre;

2. Au paragraphe 3(2) de la version française du Règlement sur la définition de « petit système de transmission par fil » (voir référence 2), « câble » est remplacé par « fil ».
ENTRÉE EN VIGUEUR 3. Le présent règlement entre en vigueur à la date de sa publication dans la Partie II de
la Gazette du Canada.
