PATENTS ACT [CHAPTER 26:03]
Declaration of Period of Emergency (HIV/AIDS) Notice 2002
IT is hereby notified that the Minister of Justice, Legal and
Parliamentary Affaris has, in terms of section 34 as read with section 35
of the Patents Act [Chapter 26:03] made the following notice:
1. This notice may be cited as the Declaration of Period of Emergency
(HIV/AIDS) Notice, 2002.
2. In view of the rapid spread of HIV/AIDS among the population of
Zimbabwe, the Minister hereby declares an emergency for a period of six
months, with effect from the date of promulgation of this notice, for the purpose of enabling the State or a person authorised by the Minister under section 34 of the Act
(a) to make or use any patented drug, including any antiretroviral drug, used in the treatment of persons suffering from HIV/AIDS or HIV/AIDS related conditions;
(b) to import any generic drug used in the treatment of persons suffering from HIV/AIDS or HIV/AIDS-related conditions.
