supplementing the Annex to Regulation (EC) No 2400/96 on the entry of certain names in the ‘Register of protected designations of origin and protected geographical indications’ provided for in Council Regulation (EEC) No 2081/92 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 2081/92 of 14 July 1992 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs (¹), as last amended by Commission Regulation (EC) No 2796/2000 (²), and in particular Article 6(3) and (4) thereof,

Whereas:

(1): In accordance with Article 5 of Regulation (EEC) No 2081/92, Greece has sent the Commission an application for the registration of the name ‘Πατάτα Κάτω Νευροκοπίου’ (Patata Kato Nevrokopiou) as a geographical indication.
(2): In accordance with Article 6(1) of that Regulation, the application has been found to meet all the requirements laid down therein and in particular to contain all the information required in accordance with Article 4 thereof.
(3): No statement of objection under Article 7 of Regulation (EEC) No 2081/92 has been received by the Commission in respect of the name given in the Annex hereto

following its publication in the Official Journal of the European Communities (³).

(4): The name should therefore be entered in the ‘Register of protected designations of origin and protected geographical indications’ and hence be protected throughout the Community as a protected geographical indication.
(5): The Annex hereto supplements the Annex to Commission Regulation (EC) No 2400/96 (⁴), as last amended by Regulation (EC) No 245/2002 (⁵),

HAS ADOPTED THIS REGULATION:

Article 1

The name in the Annex hereto is hereby added to the Annex to Regulation (EC) No 2400/96 and entered as a protected geographical indication (PGI) in the ‘Register of protected designations of origin and protected geographical indications’ provided for in Article 6(3) of Regulation (EEC) No 2081/92.

Article 2

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

que completa el anexo del Reglamento (CE) n^{^o}2400/96 relativo a la inscripción de determinadas denominaciones en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas establecido en el Reglamento (CEE) n^{^o}2081/92 del Consejo relativo a la protección de las indicaciones geográficas y de las denominaciones de origen de los productos agrícolas y alimenticios

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,

Visto el Tratado constitutivo de la Comunidad Europea,

Visto el Reglamento (CEE) n^{^o}2081/92 del Consejo, de 14 de julio de 1992, relativo a la protección de las indicaciones geográficas y de las denominaciones de origen de los productos agrícolas y alimenticios (¹), cuya última modificación la constituye el Reglamento (CE) n^{^o}2796/2000 de la Comisión (²), y, en particular, los apartados 3y4desu artículo 6,

Considerando lo siguiente:

(1): De conformidad con el artículo 5 del Reglamento (CEE) n^{^o}2081/92, Grecia presentó a la Comisión una solicitud de registro de la denominación «Πατάτα Κάτω Νευροκοπίου» (Patata Kato Nevrokopiou) como indicación geográfica.
(2): Se ha comprobado, de conformidad con el apartado 1 del artículo 6 de dicho Reglamento, que esa solicitud se ajusta a lo dispuesto en este último, y, en particular, incluye todos los datos establecidos en su artículo 4.
(3): La Comisión no ha recibido declaración alguna de oposición de conformidad con el artículo 7 del Reglamento (CEE) n^{^o}2081/92 a raíz de la publicación en el Diario Oficial de las Comunidades Europeas (³) de la denominación que figura en el anexo del presente Reglamento.

(4): Por consiguiente, dicha denominación puede inscribirse en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas y, por lo tanto, quedar protegida a escala comunitaria como indicación geográfica protegida.
(5): El anexo del presente Reglamento completa el anexo del Reglamento (CE) n^{^o}2400/96 de la Comisión (⁴), cuya última modificación la constituye el Reglamento (CE) n^{^o}245/2002 (⁵).

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El anexo del Reglamento (CE) n^{^o}2400/96 se completa con la denominación que figura en el anexo del presente Reglamento, la cual queda inscrita como indicación geográfica protegida (IGP) en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas, según lo dispuesto en el apartado 3 del artículo 6 del Reglamento (CEE) n^{^o}2081/92.

Artículo 2

El presente Reglamento entrará en vigor el vigésimo día siguiente al de su publicación en el Diario Oficial de las Comunidades Europeas.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en

cada Estado miembro.

LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

vu le traité instituant la Communauté européenne,

vu le règlement (CEE) n^{^o}2081/92 du Conseil du 14 juillet 1992 relatif à la protection des indications géographiques et des appellations d'origine des produits agricoles et des denrées alimentaires (¹), modifié en dernier lieu par le règlement (CE) n^{^o}2796/2000 de la Commission (²), et notamment son article 6, paragraphes 3 et 4,

considérant ce qui suit:

(1): Conformément à l'article 5 du règlement (CEE) n^{^o}2081/ 92, la Grèce a transmis à la Commission une demande d'enregistrement en tant qu'indication géographique pour la dénomination «Πατάτα Κάτω Νευροκοπίου» (Patata Kato Nevrokopiou).
(2): Il a été constaté, conformément à l'article 6, paragraphe 1, dudit règlement, qu'elle est conforme à ce règlement, notamment qu'elle comprend tous les éléments prévus à son article 4.
(3): Aucune déclaration d'opposition, au sens de l'article 7 du règlement (CEE) n^{^o}2081/92, n'a été transmise à la Commission à la suite de la publication au Journal officiel des Communautés européennes (³) de la dénomination figurant à l'annexe du présent règlement.

(4): En conséquence, cette dénomination mérite d'être inscrite dans le «Registre des appellations d'origine protégées et des indications géographiques protégées» et donc d'être protégée sur le plan communautaire en tant qu'indication géographique protégée.
(5): L'annexe du présent règlement complète l'annexe du règlement (CE) n^{^o}2400/96 de la Commission (⁴), modifiée en dernier lieu par le règlement (CE) n^{^o}245/ 2002 (⁵),

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

Article premier

L'annexe du règlement (CE) n^{^o}2400/96 est complétée par la dénomination figurant à l'annexe du présent règlement et cette dénomination est inscrite dans le «Registre des appellations d'origine protégées et des indications géographiques protégées» en tant qu'indication géographique protégée (IGP), prévu à l'article 6, paragraphe 3, du règlement (CEE) n^{^o}2081/92.

Article 2

Le présent règlement entre en vigueur le vingtième jour suivant celui de sa publication au Journal officiel des Communautés européennes.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans toutÉtat membre.
