COMMERCE AND INTELLECTUAL PROPERTY OFFICE ACT

An Act to provide for the establishment of the Commerce and Intellectual Property Office, and for related matters.

Be it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the House of Assembly of Saint Vincent and the Grenadines and by the authority ofthe same, as follows.

[Date of commencement: 16th December, 2003.]

1. Short title

This Act may be cited as the Commerce and Intellectual Property Office Act, 2003.

2. Interpretation

In this Act-

"Deputy Registrar" means the Deputy Registrar of the Commerce and Intellec- tual Property Office;

"Intellectual Property" has the meaning assigned to it by Article 2 of the Con- vention Establishing the World Intellectual Property Organisation signed at Stock- holm on July 14th, 1967 - ''which shall include the rights relating to-

literary, artistic and scientific works;

performances of performing artists, phonograms, and broadcasts;

inventions in all fields of human endeavour;

scientific discoveries;

industrial designs;

trade marks, service marks, and commercial names and designations;

protection against unfair competition,

and all other rights resulting from intellectual activity in the industrial, scientific, lit- erary or artistic fields";

"Registrar" means the Registrar of the Commerce and Intellectual Property Office.

3. Establishment of Commerce and Intellectual Property Office

(I) There is established by this Act the Commerce and Intellectual Property Office.

(2) The Registrar is responsible for the administration of the Commerce and Intellec- tual Property Office and may be assisted by the Deputy Registrar and other officers as are necessary for the purpose of carrying out the functions of the Registrar under this Act and under any other enactment vesting duties and responsibilities in the Registrar.

4. Functions of the Registrar

(I) The functions of the Registrar are-

(a) those assigned to the Registrar of the High Court or the Registrar of Com- panies, as the case may be, under the Acts specified in the Schedule; and

(b) those arising under any other enactment which vests duties and responsi- bilities in the Registrar.

(2) The Registrar, in conjunction with the Registrar of the High Court, shall exercise functions in the assessment and collection, as the case may be, of stamp duty on instru- ments that are required to be registered, filed, issued or stamped under the Stamp Act in relation to--

(a) charitable associations;

(b) commercial associations;

(c) intellectual property;

(d) other instruments as the Minister may by order prescribe. [Chapter 440.]

(3) The Registrar and the Deputy Registrar shall discharge any duties relating to the office of Notary Public as are necessary for the purpose of carrying out the functions referred to under subsection (1).
