Bekendtgørelse om anvendelsen af ophavsretsloven i forhold til andre lande1)

I medfør af § 88 i ophavsretsloven, jf. lovbekendtgørelse nr. 202 af 27. februar 2010, og da Danmark har tiltrådt den i Paris den 24. juli 1971 reviderede Bernerkonvention til værn for litterære og kunstneriske værker (Bernerkonventionen), den i Paris samme dag reviderede Verdenskonvention om ophavsret, den internationale konvention af 26. oktober 1961 om beskyttelse af udøvende kunstnere, fremstillere af fono‐ grammer samt radio- og fjernsynsforetagender (Romkonventionen), overenskomsten af 15. april 1994 om oprettelse af Verdenshandelsorganisationen (WTO) indeholdende aftale om handelsrelaterede intellektuel‐ le ejendomsrettigheder (TRIPS), den i Genève den 20. december 1996 vedtagne WIPO-traktat om op‐ havsret (WCT) og den i Genève den 20. december 1996 vedtagne WIPO-traktat om fremførelser og fono‐ grammer (WPPT), fastsættes:

Indledning

§ 1. Denne bekendtgørelse udvider beskyttelsen i henhold til ophavsretsloven til værker og andre frem‐ bringelser m.v., der ikke omfattes af den umiddelbare beskyttelse efter lovens §§ 85 eller 86.

Bernerkonventionen

§ 2. Bestemmelserne i ophavsretslovens kapitler 1-4 og 6-9, undtagen §§ 39-46a og § 64, anvendes med de afvigelser, som følger af bekendtgørelsens §§ 3-5, på 1) værker af personer, der er statsborgere i eller bosat i lande, som har tiltrådt konventionen til værn for

litterære og kunstneriske værker (Bernerkonventionen), 2) andre værker, som er udgivet første gang i et andet konventionsland eller er udgivet i et sådant land

samtidig med eller inden for 30 dage efter deres første udgivelse i et uden for konventionen stående land,

3) filmværker, hvis producent har sit hovedsæde i eller er bosat i et andet konventionsland, 4) bygningsværker beliggende i et andet konventionsland og 5) kunstværker, der er indføjet i bygninger eller anlæg i et andet konventionsland.

§ 3. Når beskyttelsestiden for et værk er udløbet efter den lovgivning, der gælder i værkets hjemland, nyder værket ikke beskyttelse efter ophavsretslovens bestemmelser.

Stk. 2. For værker, der først udgives i et konventionsland, anses som hjemland det konventionsland, hvor udgivelsen fandt sted. For værker, der er udgivet samtidig eller inden for 30 dage i to eller flere kon‐ ventionslande med forskellig beskyttelsestid, anses som hjemland det land, der har den korteste beskyttel‐ sestid. For værker, der er udgivet i et konventionsland samtidig med eller inden for 30 dage efter deres første udgivelse i et uden for konventionen stående land, anses konventionslandet som hjemland.

Stk. 3. For værker, der ikke er udgivet, eller som ikke er omfattet af reglerne i stk. 2, anses som hjem‐ land det konventionsland, hvor ophavsmanden er statsborger eller bosat. For bygningsværker, der er be‐ liggende i et konventionsland, og kunstværker, der er indføjet i bygninger eller anlæg beliggende i et kon‐ ventionsland, anses dette land som hjemland. For filmværker, hvis producent har hovedsæde i eller er bo‐ sat i et konventionsland, anses dette som hjemland.

§ 4. For sådanne værker af brugskunst samt industrielle mønstre og modeller, der i hjemlandet udeluk‐ kende beskyttes som mønstre og modeller, ydes der alene beskyttelse efter den danske lovgivning om de‐ sign.

§ 5. Bestemmelsen i ophavsretslovens § 38 (følgeret) finder anvendelse på værker af personer, der er statsborgere i eller bosat i konventionslande, som har gennemført en følgeretsordning som omhandlet i Bernerkonventionens art. 14 ter.

WIPO-traktaten om ophavsret (WCT)

§ 6. Bestemmelserne i §§ 2-5 finder tilsvarende anvendelse i forhold til lande, der har tiltrådt WIPO- traktaten om ophavsret (WCT).

Verdenskonventionen om ophavsret

§ 7. Bestemmelserne i ophavsretslovens kapitler 1-4 og 6-9, undtagen bestemmelserne i §§ 38-46a og § 64, anvendes med de afvigelser, som følger af anordningens §§ 8-10, på 1) værker af personer, der er statsborgere i lande, som er tilsluttet Verdenskonventionen om ophavsret af

1952 eller den i Paris den 24. juli 1971 reviderede konventionstekst, 2) andre værker, som er udgivet første gang i et andet konventionsland, 3) værker af personer, der er bosat i et andet konventionsland, under forudsætning af, at dette land i sin

lovgivning har ligestillet sådanne personer med sine egne statsborgere i henseende til anvendelsen af Verdenskonventionen, og

4) værker af statsløse og flygtninge, som er bosat i lande tilsluttet tillægsprotokol 1 til Verdenskonventi‐ onen.

§ 8. Når beskyttelsestiden for et værk er udløbet efter den i værkets hjemland gældende lovgivning, ny‐ der værket ikke beskyttelse efter ophavsretslovens bestemmelser.

Stk. 2. Når et værk er udgivet første gang i et konventionsland, anses dette land som værkets hjemland. I tilfælde af værkets udgivelse samtidig eller inden for 30 dage i to eller flere konventionslande med for‐ skellig beskyttelsestid, anses dog som værkets hjemland det land, der har den korteste beskyttelsestid.

Stk. 3. Når et værk er udgivet første gang i et uden for konventionen stående land, anses som værkets hjemland det land, i hvilket værkets ophavsmand er statsborger.

Stk. 4. For et ikke-udgivet værk anses som hjemland det land, i hvilket værkets ophavsmand er statsbor‐ ger.

§ 9. Bestemmelsen i § 7 gælder ikke for værker, som er frembragt, før konventionen trådte i kraft for vedkommende stat, medmindre denne stat beskytter danske værker, som er frembragt før dette tidspunkt.

§ 10. Bestemmelserne i §§ 7-9 gælder ikke for 1) værker, som er omfattet af bestemmelserne i § 2, og 2) værker fra et land, som efter 1. januar 1951 er udtrådt af Bernerunionen, medmindre dette land efter

pkt. b i tillægsdeklarationen til art. XVII i den i Paris i 1971 reviderede konventionstekst er at anse for udviklingsland og ved udtrædelsen af Bernerunionen hos UNESCO᾽s generaldirektør har depone‐ ret meddelelse om, at landet betragter sig som et udviklingsland.

§ 11. Bestemmelserne i ophavsretslovens kapitler 1-4 og 6-9, undtagen bestemmelserne i §§ 38-46a og § 64, finder anvendelse på værker, som først er udgivet af De Forenede Nationer (FN), af de specielle organisationer knyttet til FN eller af Organisationen af Amerikanske Stater, samt på ikke-udgivne værker, som de nævnte organisationer har ret til at udgive.

Romkonventionen

§ 12. Bestemmelserne i ophavsretslovens § 65 (udøvende kunstnere), undtagen henvisningerne i § 65 til §§ 39-46a, anvendes, 1) hvis fremførelsen har fundet sted i et konventionsland, eller 2) hvis fremførelsen er gengivet på en lydoptagelse, som er fremstillet af en person, der er statsborger i

eller bosat i et konventionsland, eller 3) hvis fremførelsen er gengivet på en lydoptagelse, som er fremstillet af et selskab, som har hovedsæde

i et konventionsland. Stk. 2. Bestemmelserne om tilgængeliggørelse for almenheden af fremførelser og optagelser i ophavs‐

retslovens § 65, stk. 1-2 og 4, finder for så vidt angår samtidig og uændret videreudsendelse over kabelan‐ læg eller trådløst ikke anvendelse på andre lande.

§ 13. Bestemmelserne i ophavsretslovens § 66 (fremstillere af lydoptagelser) og de dertil hørende be‐ stemmelser i loven, undtagen henvisningerne i § 66 til §§ 39-46a, anvendes, 1) hvis lydoptagelsen har fundet sted i et konventionsland, eller 2) hvis lydoptagelsen er fremstillet af en person, der er statsborger i eller bosat i et konventionsland, el‐

ler 3) hvis lydoptagelsen er fremstillet af et selskab, som har hovedsæde i et konventionsland.

§ 14. Uanset bestemmelserne i §§ 12 og 13 finder bestemmelsen i ophavsretslovens § 68, stk. 2, om ydelse af vederlag til fremstillere af lydoptagelser og udøvende kunstnere i tilfælde af offentlig fremførel‐ se af udgivne lydoptagelser kun anvendelse i det omfang og for det tidsrum, vedkommende land beskytter lydoptagelser med tilknytning til Danmark. Det forhold, at vedkommende land ikke beskytter begge de to grupper af rettighedshavere, som er nævnt i § 68, stk. 2, skal ikke anses som en forskel i omfanget af beskyttelsen.

§ 15. Bestemmelsen i ophavsretslovens § 69 (radio- og fjernsynsforetagender) og de dertil hørende be‐ stemmelser i loven anvendes, 1) hvis radio- og fjernsynsudsendelsen har fundet sted i et konventionsland, eller 2) hvis radio- og fjernsynsforetagendet har hovedsæde i et andet konventionsland.

Stk. 2. Bestemmelsen om udsendelse af radio- og fjernsynsudsendelser i ophavsretslovens § 69, stk. 1, finder for så vidt angår fordeling over kabelanlæg ikke anvendelse på andre lande.

WIPO-traktaten om fremførelser og fonogrammer (WPPT)

§ 16. Bestemmelserne i §§ 12 og 13 finder tilsvarende anvendelse i forhold til lande, der har tiltrådt WIPO-traktaten om fremførelser og fonogrammer (WPPT).

Stk. 2. Uanset bestemmelsen i stk. 1 finder bestemmelsen i ophavsretslovens § 68, stk. 2, om ydelse af vederlag til fremstillere af lydoptagelser og udøvende kunstnere i tilfælde af offentlig fremførelse af ud‐ givne lydoptagelser ikke anvendelse i det omfang, et andet traktatland gør brug af de forbehold, der er tilladt efter traktatens art. 15, stk. 3.

Stk. 3. Bestemmelsen i stk. 1 finder ikke anvendelse på udøvende kunstneres fremførelser, som er gen‐ givet på film eller anden audiovisuel fremstilling.

Stk. 4. Bestemmelserne i ophavsretslovens §§ 75 c-75 e finder tilsvarende anvendelse i forhold til lande, der har tiltrådt WIPO-traktaten om fremførelser og fonogrammer (WPPT).

Overenskomsten om Verdenshandelsorganisationen (WTO), herunder aftale om handelsrelaterede intellektuelle ejendomsrettigheder (TRIPS)

§ 17. Bestemmelserne i §§ 2-5 finder tilsvarende anvendelse i forhold til lande, der har tiltrådt overens‐ komsten om Verdenshandelsorganisationen (WTO), herunder aftale om handelsrelaterede intellektuelle ejendomsrettigheder (TRIPS).

Stk. 2. Bestemmelserne i §§ 12, 13 og 15 finder med de i disse bestemmelser indeholdte afvigelser til‐ svarende anvendelse i forhold til lande, der har tiltrådt WTO, herunder TRIPS-aftalen. Bestemmelserne i ophavsretslovens § 65, stk. 2, og § 66, stk. 1, finder dog for så vidt angår offentlig fremførelse af optagel‐ ser kun anvendelse i forhold til de i §§ 12 og 13 nævnte lande.

Særligt om udbetaling af vederlag efter ophavsretslovens §§ 39-46a om vederlag for eksemplarfremstilling til privat brug

§ 18. Bestemmelserne om udbetaling af vederlag for eksemplarfremstilling til privat brug i ophavsrets‐ lovens §§ 39-46a finder anvendelse på 1) værker og fotografiske billeder frembragt eller fremstillet af personer, der er statsborgere i eller bosat

i andre lande, under forudsætning af, at der i det pågældende land er gennemført en vederlagsordning for uindspillede bånd, som åbner mulighed for vederlag til danske rettighedshavere, og

2) filmværker, hvis producent har sit hovedsæde i eller er bosat i andre lande, under forudsætning af, at der i det pågældende land er gennemført en vederlagsordning for uindspillede bånd, som åbner mulig‐ hed for vederlag til danske rettighedshavere.

Stk. 2. Bestemmelserne i stk. 1 finder ikke anvendelse, når beskyttelsestiden for værket eller billedet er udløbet i rettighedshaverens hjemland.

§ 19. Bestemmelserne i ophavsretslovens §§ 65 og 66, jf. §§ 39-46a, om udbetaling af vederlag for ek‐ semplarfremstilling til privat brug, finder anvendelse på fremførelser og lydoptagelser med tilknytning til andre lande, jf. kriterierne i §§ 12 og 13, under forudsætning af, at der i det pågældende land er gennem‐ ført en vederlagsordning for uindspillede bånd, som åbner mulighed for vederlag til danske rettighedsha‐ vere.

Stk. 2. Bestemmelsen i stk. 1 finder ikke anvendelse, når beskyttelsestiden for fremførelsen eller lydop‐ tagelsen er udløbet i rettighedshaverens hjemland.

Aftale om udvidelse af den retlige beskyttelse af databaser til Isle of Man

§ 20. Bestemmelsen i ophavsretslovens § 71 finder anvendelse på 1) databaser, som er fremstillet af personer bosat i Isle of Man, eller 2) databaser, som er fremstillet af selskaber, der har hovedsæde i Isle of Man.

Ikrafttræden m.v.

§ 21. Bekendtgørelsen træder i kraft den 14. marts 2010. Stk. 2. Anordning nr. 1213 af 17. december 2002 om anvendelsen af ophavsretsloven i forhold til andre

lande m.v. ophæves.

1) Bestemmelsen i § 20 gennemfører Rådets afgørelse af 18. februar 2003 om indgåelse af en aftale i form af brevveksling mellem Det Forenede Kongerige Storbritannien og Nordirland på vegne af Isle of Man og Det Europæiske Fællesskab om udvidelse til Isle of Man af den retlige beskyttelse af databaser i henhold til kapitel III i direktiv 96/9/EF (EF-Tidende 2003 nr. L 989, side 11).

Order on the Application of the Act on Copyright in Relation to Other Countries1

(Order no. 218 of March 9 2010)

Pursuant to section 88 of the Copyright Act, cf. Consolidated Act No. 202 of February 27 2010, and whereas Denmark has acceded to the Berne Convention for the Protection of Literary and Artistic Works, as revised at Paris on July 24, 1971(Berne Convention), the Universal Copyright Convention, as revised at Paris on the same date, the International Convention of October 26, 1961 for the Protection of Performers, Producers ofPhonograms and Broadcasting Organisations (the Rome Convention), and the Agreement of April15, 1994 on Establishment of the World Trade Organization (WTO) containing an Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), the WIPO Copyright Treaty (WCT) as approved in Geneva on December 20, 1996, the WIPO Performances and Phonograms Treaty (WPPT) as approved in Geneva on December 20, 1996, the following rules are laid down:

Introduction

1. This Order extends protection under the Copyright Act to works and other performances or productions, etc. that are not comprised by the immediate protection according to sections 85 and 86 of the Act.

The Berne Convention

2. The provisions of chapters 1-4 and 6-9 ofthe Copyright Act, with the exception of sections 39- 46a and section 64, shall be applied subject to the derogations following from sections 3-5 of this Order to (i) works by persons who are nationals of or who have their habitual residence in countries that have acceded to the Convention for the Protection of Literary and Artistic Works (the Berne Convention); (ii) other works published for the first time in another Contracting State or published in such a country simultaneously with or within 30 days after their first publishing in a non-Contracting State; (iii) cinematographic works, the producer of which has his headquarters or his habitual residence in another Contracting State; (iv) works of architecture situated in another Contracting State; (v) works of art which have been incorporated in buildings or structures in another Contracting State.

3.-(1) Where the term of protection for a work has expired according to the legislation in force in the country of origin of the work, the work shall not enjoy protection under the provisions of the Copyright Act.

(2) For works first published within a Contracting State, the Contracting State in which the work was published shall be deemed to be the country of origin. For works published simultaneously or

within 30 days in two or more Contracting States with different terms of protection, the country which has the shortest term of protection shall be deemed to be the country of origin. For works published in a Contracting State simultaneously with or within 30 days after the first publishing in a non-Contracting State, the Contracting State shall be deemed to be the country of origin.

(3) For unpublished works or for works which are not comprised by the provisions of subsection (2), the Contracting State of which the author is a national or where he has his habitual residence shall be deemed to be the country of origin. For works of architecture situated in a Contracting State and works of art incorporated in buildings or structures situated in a Contracting State, this country shall be deemed to be the country of origin. For cinematographic works, the Contracting State in which the producer has his headquarters or habitual residence shall be deemed to be the country of ongm.

4. For such works of applied art and industrial designs and models which in the country of origin are solely protected as designs and models, protection shall solely be given under Danish designs legislation.

5. The provision of section 38 of the Copyright Act (droit de suite) shall apply to works of persons who are nationals of or who have their habitual residence in Contracting States which have implemented a droit de suite provision as mentioned in Article 14 ter of the Berne Convention.

The WIPO Copyright Treaty (WC1)

6. The provisions of sections 2-5 shall apply accordingly in relation to countries which have acceded to the WIPO Copyright Treaty (WCT).

The Universal Copyright Convention

7. The provisions of chapters 1-4 and 6-9 of the Copyright Act, with the exception of the provisions of sections 38-46a and section 64, shall be applied subject to the derogations following from sections 8-10 of this Order to (i) works by persons who are nationals of countries that are parties to the Universal Copyright Convention of 1952 or the Convention as revised at Paris on July 24, 1971; (ii) other works published for the first time in another Contracting State; (iii) works by persons who have their habitual residence in another Contracting State provided that this state, in its legislation, accords such persons equal treatment with its own nationals in respect to the application of the Universal Copyright Convention; (iv) works by stateless persons and refugees who have their habitual residence in countries that have acceded to Protocol! annexed to the Universal Copyright Convention.

8.-(1) Where the term of protection for a work has expired according to the legislation in force in the country of origin of the work, the work shall not enjoy protection under the provisions of the Copyright Act.

(2) Where a work has been published for the first time in a Contracting State, this country shall be deemed to be the country of origin of the work. In the case of a work being published simultaneously or within 30 days in two or more Contracting States with different terms of

protection, the country which has the shortest term of protection shall be deemed to be the country of origin.

(3) Where a work has been published for the first time in a non-Contracting State, the country of which the author is a national shall be deemed to be the country of origin of the work.

(4) For an unpublished work, the country of which the author of the work is a national shall be deemed to be the country of origin.

9. The provision of section 7 shall not apply to works created before the coming into force of the Convention for the state concerned unless this state protects Danish works created before that time.

10. The provisions of sections 7-9 shall not apply to (i) works comprised by the provisions of section 2; and (ii) works, the country of origin of which, after January 1, 1951, has withdrawn from the Berne Union, unless such country according to paragraph (b) of the Appendix Declaration Relating to Article XVII of the Convention text as revised at Paris in 1971, is deemed to be a developing country and at the time of its withdrawal from the Berne Union has deposited with the Director General of UNESCO a notification to the effect that it considers itself to be a developing country.

11. The provisions of chapters 1-4 and 6-9 of the Copyright Act, with the exception of the provisions of sections 38-46a and section 64, shall apply to works first published by the United Nations (UN), by the specialized agencies attached to the UN or by the Organization of American States, and to unpublished works which the above organizations are entitled to publish.

The Rome Convention

12.-(1) The provisions of section 65 of the Copyright Act (performing artists), with the exception of the references in section 65 to sections 39-46a, shall apply (i) if the performance has taken place in a Contracting State; or (ii) if the performance has been reproduced on a sound recording made by a person who is a national of or who has his habitual residence in a Contracting State; or (iii) if the performance has been reproduced on a sound recording made by a company which has its headquarters in a Contracting State.

(2) The provisions of section 65(1), (2) and (4) of the Copyright Act on making performances and recordings available to the public shall in so far as simultaneous and unchanged distribution through cable systems or wireless is concerned do not apply to other countries.

13. The provisions of section 66 of the Copyright Act (producers of sound recordings) and the provisions of the Act relating thereto, with the exception of the references in section 66 to sections 39-46a, shall apply (i) if the sound recording has taken place in a Contracting State or (ii) if the sound recording has been made by a person who is a national of or who has his habitual residence in a Contracting State; or (iii) if the sound recording has been made by a company which has its headquarters in a Contracting State.

14. Notwithstanding the provisions of sections 12 and 13, the provision of section 68(2) of the Copyright Act on remuneration to producers of sound recordings and performing artists in case of public performance of published sound recordings shall apply only to the extent that and for the term during which the country concerned protects sound recordings with attachment to Denmark. The fact that the country concerned does not protect either of the two groups ofrightholders as mentioned in section 68(2) shall not be deemed to be a difference in the extent of the protection.

15.-(1) The provision of section 69 of the Copyright Act (broadcasters) and the provisions of the Act relating thereto shall apply (i) if the radio and television broadcast has taken place in a Contracting State, or (ii) if the broadcaster has its headquarters in other Contracting States.

(2) The provision of section 69(1) of the Copyright Act on retransmission of radio and television broadcasts shall not apply to other countries in so far as distribution through cable systems is concerned.

The WIPO Performances and Phonograms Treaty (WPPT)

16.-(1) The provisions of sections 12 and 13 shall apply in relation to other countries which have acceded to the WIPO Performances and Phonograms Treaty (WPPT).

(2) Notwithstanding the provision of subsection (1 ), the provision of section 68(2) of the Copyright Act on remuneration to producers of sound recordings and performing artists in case of public performance of published sound recordings shall not apply to the extent that another Contracting Party makes use of the reservations permitted by Article 15(3) of the Treaty.

(3) The provision of subsection (1) shall not apply to performing artists' performances, which is reproduced on film or other audiovisual production.

(4) The provisions of sections 75c-75e of the Copyright Act shall also apply in relation to countries which have acceded to the WIPO Performances and Phonograms Treaty (WPPT).

The Agreement on the World Trade Organization (WTO), including Agreement on Trade- RelatedAspects ofIntellectual Property Rights (TRIPS)

17.-(1) The provision of sections 2-5 shall apply correspondingly in relation to countries that have acceded to the Agreement on the World Trade Organization (WTO), including the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

(2) The provisions of sections 12, 13 and 15 shall with the derogations contained in these provisions apply correspondingly in relation to countries that have acceded to the Agreement on the World Trade Organization (WTO), including the TRIPS Agreement. The provisions of section 65(2) and section 66(1) of the Copyright Act shall, however, apply only in relation to the countries mentioned in sections 12 and 13 in so far as public performance of recordings is concerned.

Special Provisions on Payment ofRemuneration in accordance with Sections 39-46a ofthe Copyright Act on Remuneration for Reproduction for Private Use

18.-(1) The provisions on payment of remuneration for reproduction for private use of sections 39- 46a of the Copyright Act shall apply to

(i) works and photographic pictures created or produced by persons who are nationals of or who have their habitual residence in other countries provided that a blank tapes remuneration scheme has been implemented in the country concerned which provides a possibility for payment of remuneration to Danish rightholders; and (ii) cinematographic works, the producer of which has his headquarters or his habitual residence in another country provided that a blank tapes remuneration scheme has been implemented in the country concerned which provides a possibility for payment of remuneration to Danish rightholders.

(2) The provisions of subsection (1) shall not apply where the term of protection for the work or the picture has expired in the country of the rightholder.

19.-(1) The provisions of sections 65 and 66, cf. sections 39-46a of the Copyright Act, on payment of remuneration for reproduction for private use shall apply to performances and sound recordings with attachment to other countries, cf. the criteria of sections 12 and 13, provided that a blank tapes remuneration scheme has been implemented in the country concerned which provides a possibility for payment of remuneration to Danish rightholders.

(2) The provision of subsection (1) shall not apply where the term of protection for the performance or the sound recording has expired in the country of the rightholder.

Agreement on the extension oflegal protection ofdatabases to the Isle ofMan

20. The provision of section 71 of the Copyright Act shall apply to (i) databases that are created by persons residing in the Isle of Man, or (ii) databases that are created by companies headquartered in the Isle of Man.

Coming into Force, etc.

21.-(1) This Order shall come into force on March 14, 2010. (2) Ordinance No. 1213 of December 17 2002 on the Application of the Copyright Act with

Respect to Other Countries etc., and Ordinance No. 159 of March 17, 2004 amending the Ordinance on the Application of the Copyright Act with Respect to Other Countries shall be repealed.
