Details Details Year of Version 1940 Dates Entry into force: September 17, 1940 Published: September 9, 1940 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights) Subject Matter (secondary) IP Regulatory Body Notes This Decree implements Article 62 of the Law No. 11.723 of September 28, 1933 on Legal Intellectual Property Regime which relates to the deposit of unpublished works.
According to Article 1 of the Decree, the National Directorate of Copyrights (formely known as the National Intellectual Property Registry) has authority to return the unpublished works deposited in the manner established by Decree 31.964 of 1939, provided that the person who carries out the devolution is the same as the one declared as author in the application of the deposit.

Article 2 of the Civil Code stipulates: “Laws shall not be binding until after their publication, and as of the stated day. If no day is stated, they shall be binding eight days following their official publication.”
This Decree was published in the Official Gazette on September 9, 1940 (B.O. 09/09/40), with no specific date of entry into force; based on Article 2 of the Civil Code it entered into force eight days after its publication.

DECRETO 71.180/40* DEVOLUCION DE OBRAS INEDITAS

DEPOSITADAS "EN CUSTODIA"

Articulo 12 - Autorizase a la Direcci6n N acional del Derecho de Autor a devolver la obra inedita, depositada "en custodia" en la forma establecida por el decreto de fecha 29 de mayo de 1939, de conformidad al art. 62 de la ley 11.723, siempre que la persona que recabe su devoluci6n sea la declarada como autor de la obra **.
