Details Details Year of Version 2014 Dates Commenced: October 27, 2014 Published: October 27, 2014 Issued: October 20, 2014 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Utility Models Notes The notification by Seychelles to the WTO under article 63.2 of TRIPS states:
'The 'Industrial Property (Patents) Regulations, 2014' comprised provisions with respect to; the requirements that would need to be met to secure a patent; the subject matters that were excluded from patent protection for policy reasons and practical considerations: who was eligible for patent protection; the procedures related to the filing and processing of patent applications; the right conferred by a patent; and the limitations imposed on the rights of a patentee, including safeguard mechanisms.

Under the Act, the Registrar of patents is responsible for the registration of patents. According to this Act, any person-whether a citizen of Seychelles or not–could file an application for a patent. The right to an invention was confirmed by a patent which certified the ownership, priority and exclusive right of the patentee to use his/her invention.

Pursuant to the 'Industrial Property (Patents) Regulations, 2014', patents for inventions were valid for 20 years from the date the application was received by the Registrar of Patents.

Currently there is no protection provided for plant varieties. The legislation which will provide protection for new plant varieties is in the process of being drafted. Seychelles is expected to accede to the International Union for the Protection of New Varieties of Plants in the near future.'
