The Secretary of State, in exercise of the powers conferred upon him by section 47(4) of the Copyright, Designs and Patents Act 19881, hereby makes the following Order:

1. This Order may be cited as the Copyright (Material Open to Public Inspection) (Marking of Copies of Maps) Order 1989 and shall come into force on 1st August 1989.
2. Subsections (2) and (3) of section 47 of the Copyright, Designs and Patents Act 1988 shall, in the case of a map which is open to public inspection pursuant to a statutory requirement, or is on a statutory register, apply only to copies of the map marked in the following manner-
"This copy has been made by or with the authority of [insert the name of the person required to make the map open to public inspection or the person maintaining the register] pursuant to section 47 of the Copyright, Designs and Patents Act 1988 ("the Act"). Unless the Act provides a relevant exception to copyright, the copy must not be copied without the prior permission of the copyright owner.".

EXPLANATORY NOTE

(This note is not part of the Order)

Subsections (2) and (3) of section 47 of the Copyright, Designs and Patents Act 1988 provide exceptions to copyright in the case of material which is open to public inspection pursuant to a statutory requirement or which is on a statutory register. The Order provides that, in the case of copies of maps, the exceptions in subsections (2) and (3) only apply to copies which are marked with a copyright warning.
