The notification by the United Kingdom to the WTO under article 63.2 of TRIPS states:
'The Regulations amend The Design Right (Semiconductor Topographies) Regulations 1989 (SI 1989, No. 1100) to show the current position on the additional classes of qualifying persons enjoying legal protection of topographies of Integrated Circuits.'

The Secretary of State, being designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the conferment and protection of exclusive rights in the topographies of semiconductor products, in exercise of the powers conferred upon him by the said section 2(2), hereby makes the following Regulations:

1. These Regulations may be cited as the Design Right (Semiconductor Topographies) (Amendment) Regulations 1993 and shall come into force on 10th November 1993.
2. The Design Right (Semiconductor Topographies) Regulations 19893 shall be amended by substituting for the Schedule thereto the Schedule set out in the Schedule to these Regulations.

QUALIFYING PERSONS
PART 1
DESCRIPTIONS OF ADDITIONAL CLASSES
1. British Dependent Territory citizens.
2. Citizens and subjects of any country specified in Part II below.
3. Habitual residents of any country specified in Part II below, the Isle of Man, the Channel Islands or any colony.
4. Firms and bodies corporate formed under the law of, or of any part of, the United Kingdom, Gibraltar, another member State of the European Economic Community or any country specified in Part II below with a place of business within any country so specified at which substantial business activity is carried on.
PART II
SPECIFIED COUNTRIES: CITIZENS, SUBJECTS,
HABITUAL RESIDENTS, BODIES CORPORATE
AND OTHER BODIES HAVING

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations replace the Schedule to the Design Right (Semiconductor Topographies) Regulations 1989 with two new Parts to show the current position on the additional classes of qualifying persons enjoying legal protection of topographies of semiconductor products. The addition of Liechtenstein to the Part II countries gives effect to Council Decision 90/511/EEC (O.J. No. L285, 17.10.1990, page 31). The United States of America is included in that Part by virtue of Council Decision 93/16/EEC (O.J. No. L11, 19.1.93, page 20), and Commission Decision 93/217/EEC (O.J. No. L94, 20.4.93, page 30). Iceland and Norway, which were shown under Part III of the earlier Schedule (which related to citizens, subjects and habitual residents only of the countries specified) are now shown under Part II by virtue of Council Decision 93/17/EEC (O.J. No. L11, 19.1.93, page 22). With these changes, no countries remain in Part III of the earlier Schedule and accordingly that Part is omitted from the new Schedule.
