Loi du 25 avril 2008 relative à la modification de la loi modifiée du 20 juillet 1992 portant modification du régime des brevets d’invention.

Nous Henri, Grand-Duc de Luxembourg, Duc de Nassau,
Notre Conseil d’Etat entendu;
De l’assentiment de la Chambre des Députés;
Vu la décision de la Chambre des Députés du 31 janvier 2008 et celle du Conseil d’Etat du 19 février 2008 portant qu’il n’y a pas lieu à second vote;

Avons ordonné et ordonnons:

Article unique. A l’article 47quinquies de la loi modifiée du 20 juillet 1992 portant modification du régime des brevets d’invention, il est inséré un nouveau paragraphe 3, libellé comme suit:

    «3. La protection visée aux articles 47bis et 47ter ne s’étend pas à la matière biologique dont l’obtention dans le domaine de l’agriculture est due au hasard ou est techniquement inévitable.»

Les paragraphes 3, 4 et 5 de l’article 47quinquies sont renumérotés 4, 5 et 6.

Mandons et ordonnons que la présente loi soit insérée au Mémorial pour être exécutée et observée par tous ceux que la chose concerne.
