Protection of Foreign Works under the Universal Copyright Convention

Copyright (International Convention) Order, 5715—1955*

  1. In this Order, “the Convention” means the Universal Copyright Convention adopted at Geneva on the 6th September, 1952.

  2. A published work of an author who is a citizen or national of one of the member countries of the Convention, and a work first published in such a country, shall be protected in Israel as if it had been first published in Israel.

  3. An unpublished work of an author who at the date of the making thereof was a citizen or national of one of the member countries of the Convention shall be protected in Israel as if its author were an Israel national.

  4. Notwithstanding the provisions of paragraphs 2 and 3, the period of protection granted in Israel to the works referred to in those paragraphs shall be limited:

(1)
in the case of a published work—to the period of protection fixed for a work of the same class in the country of first publication;
(2)
in the case of an unpublished work—to the period of protection granted in the country of which the author is a citizen or national.
5. For the purpose of determining the country of publication:
(1)
a work of an author who is a citizen or national of one of the member countries of the Convention, and which was first published in a country not being a member country, shall be deemed to have been first published in the country of which the author is a citizen or national;
(2)
a work published simultaneously in two or more of the member countries of the Convention shall be deemed to have been first published in that of the said countries the laws of which grant to that work the shortest period of protection.
    1. The provisions of this Order shall not apply to works to which the Copyright (Berne Convention) Order, 5713—1953, applies.

    2. 7. This Order shall come into effect on the 29th Elul, 5715 (16th September 1955).
  1. This order shall be cited as the Copyright (Universal Convention) Order, 5715— 1955.
