The Criminal Code

Article 147. Violation of Invention Rights.

(1) For intentional disclosure of an invention without consent of the inventor before he has applied for a patent, as well as for fraudulently claiming authorship of the invention, or imposition of joint authorship, the sentence shall be deprivation of freedom for a period not exceeding three years, or arrest, or a monetary fine not exceeding fifty minimum monthly wages.

(2) For coercing an individual to disclaim his invention rights by use of violence or the threat of violence or blackmailing, or for imposition of joint authorship, the sentence shall be deprivation of freedom for a period not exceeding five years, or arrest, or a monetary fine not exceeding hundred minimum monthly wages.

Article 148. Violation of Copyrights and Related Rights.

(1) For intentional violation of copyrights or related rights by violating rights of author to publish or announce and use of his work, and by violating related rights of their owners, the sentence shall be forced labour or a monetary fine not exceeding sixty minimum monthly wages, with or without confiscation of property.

(2) For the same repeated action or the same action by group of persons pursuant to an advance agreement, the sentence shall be deprivation of freedom for a period not exceeding three years, or arrest, or a monetary fine not exceeding hundred minimum monthly wages, with or without confiscation of property.

(3) For misappropriation of copyrights, for coercing to disclaim copyrights by use of violence or the threat of violence or blackmailing, or for imposing joint authorship, the sentence shall be deprivation of freedom for a period not exceeding five years or a monetary fine not exceeding hundred and sixty minimum monthly wages, with or without confiscation of property.

Article 149. Illegal operations with objects of copyrights and related rights.

(1) For obtaining tangible benefits by use of objects of copyrights or related rights which are published, announced, publicly performed or otherwise used by violating copyrights or related rights, the sentence shall be deprivation of freedom for a period not exceeding two years, or arrest, or a monetary fine not exceeding eighty minimum monthly wages, with or without confiscation of property.

(2) For obtaining objects, specified in the first part of this paragraph in order to sell, store or conceal them, the sentence shall be forced labour or a monetary fine not exceeding forty minimum monthly wages, with or without confiscation of property.
