ENACTING PROVISIONS REGARDING THE PROTECTION OF COPYRIGHT AND RELATED RIGHTS IN DECISION 351 OF THE CARTAGENA AGREEMENT

SUPREME DECREE NO. 03-94-ITINCI

The President of the Republic

WHEREAS:

Through Decision 351 of the Board of the Cartagena Agreement, the new Common Provisions on Copyright and Related Rights for Member Countries have been established; and Decision 351 establishes the powers of the Offices and Competent National Authorities to enforce and protect copyright and related rights;

The status of Office and Competent National Authority for the purposes of such Decision, in accordance with existing national legislation, should be specified;

Similarly, the power of individuals to pursue directly judicial remedies for alleged offenses related to copyright and related rights should be specified; and matters regarding the enforcement of administrative sanctions as distinct from criminal sanctions should be clarified;

Pursuant to the provisions of Article 118(8) of the Political Constitution of Peru;

DECREES:

Article 1.— It is specified that pursuant to Decree-Law No. 25868 and Supreme Decree No. 025-93-ITINCI, the dual status of Office and Competent National Authority as regards copyright and related rights to which Decision 351 of the Board of the Cartagena Agreement refers, is incumbent on the Copyright Office of the National Institute for the Defense of Competition and Protection of Intellectual Property (INDECOPI), except for the provisions set out in the following articles.

Article 2.— The judiciary is the only Competent National Authority for ordering embargoes, pursuant to the provisions of Article 56(b) and (c) of Decision 351 of the Board of the Cartagena Agreement; as well as exercising the powers stipulated in Article 57(a), (b) and (d) of the aforegoing Decision.

Article 3.— It is specified that the competence of the Copyright Office, both as Competent National Authority, in the framework of Decision 351 of the Cartagena Agreement and as Competent Administrative Authority, pursuant to Decree-Law No. 25868, does not prevent interested persons from choosing, as regards matters which constitute an alleged offense, to pursue criminal proceedings directly. Administrative sanctions shall be applied without prejudice to any sanctions that might ensue.

Article 4.— When the subject matter of the administrative proceedings constitutes an alleged offence, the Copyright Office of INDECOPI may file a criminal complaint with the Office of the Public Prosecutor.

In the event that the Administrative Authority has destroyed or disposed of the samples of copyright infringement, in accordance with the provisions of Article 129(2) of Law No. 13714 and of Article 57(c) of Decision 351 of the Board of the Cartagena Agreement, the criminal complaint shall be accompanied by a certified copy of the administrative decision and the proceedings related to such measures in which a link to the goods concerned is established, for the purposes of assessing it as evidence of an alleged offense.

Article 5.— This Supreme Decree shall be countersigned by the President of the Council of Ministers, the Minister of Foreign Relations and the Minister of Industry, Tourism, Integration and International Trade Negotiations.

DICTAN DISPOSICIONES REFERIDAS A LA PROTECCION DE LOS DERECHOS DE AUTOR Y DERECHOS CONEXOS ESTABLECIDOS EN LA DECISION 351 DEL ACUERDO DE CARTAGENA

DECRETO SUPREMO No 03-94-ITINCI

El Presidente de la República

CONSIDERANDO:

Que mediante la Decisión 351 de la Comisión del Acuerdo de Cartagena se ha establecido en el nuevo Régimen Común sobre Derechos de Autor y Derechos Conexos para los Países Miembros; Que, la Decisión 351 establece las atribuciones de las Oficinas y Autoridades Nacionales Competentes a fin de cautelar y proteger los Derechos de Autor y Derechos Conexos;

Que, es conveniente precisar la condición de Oficina y Autoridad Nacional Competente para los efectos de dicha Decisión, en concordancia con la legislación nacional vigente;

Que asimismo, conviene precisar la facultad de los particulares de recurrir directamente a la vía judicial tratándose de los presuntos delitos vinculados con los Derechos de Autor y conexos; aclarando al mismo tiempo lo relativo a la aplicación de las sanciones administrativas como distintas a las penales;

De conformidad con lo dispuesto en el inciso 8) del Artículo 118 de la Constitución Política del Perú;

DECRETA:

Artículo 1.- Precísese que conforme al Decreto Ley No 25868 y Decreto Supremo No 025-93-ITINCI, corresponde a la Oficina de Derechos de Autor del Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual -INDECOPI-, la doble condición de Oficina y Autoridad Nacional Competente en materia de Derechos de Autor y Derechos Conexos a que se refiere la Decisión 351 de la Comisión del Acuerdo de Cartagena, salvo lo dispuesto en los artículos siguientes.

Artículo 2.- El Poder Judicial es la única Autoridad Nacional Competente para ordenar embargos, según lo dispuesto en los incisos b) y c) del Artículo 56 de la Decisión 351 de la Comisión del Acuerdo de Cartagena; así como para ejercer las atribuciones señaladas en los incisos a), b) y d) del Artículo 57 de la mencionada Decisión.

Artículo 3.- Precísese que la competencia de la Oficina de Derechos de Autor, tanto como Oficina Nacional Competente, en el marco de la Decisión 351 del Acuerdo de Cartagena y como Autoridad Administrativa Competente, según el Decreto Ley No 25868, no es óbice para que los interesados opten por recurrir, en los asuntos que constituyan presunto delito, directamente a la vía penal. Las sanciones administrativas se aplicarán sin perjuicio de las sanciones a que hubiere lugar.

Artículo 4.- Cuando los hechos materia del procedimiento administrativo constituyan presunto delito, la Oficina de Derechos de Autor del INDECOPI podrá formular denuncia penal ante el Ministerio Público.

En caso de que la Autoridad Administrativa hubiera destruido o dispuesto de los ejemplares que constituían materia de infracción de los Derechos de Autor, conforme a lo establecido en el numeral 2) del Artículo 129 de la Ley No 13714 e inciso c) del Artículo 57 de la Decisión 351 de la Comisión del Acuerdo de Cartagena, a la denuncia penal se acompañará copia certificada de la resolución administrativa y de las Actas vinculadas con tales medidas en las que conste la relación de los bienes objeto de las mismas, a efectos de su valoración como prueba del presunto delito.

Artículo 5.- El presente Decreto Supremo será refrendado por el Presidente del Consejo de Ministros y Ministro de Relaciones Exteriores, y por la Ministra de Industria, Turismo, Integración y Negociaciones Comerciales Internacionales.

Dado en la Casa de Gobierno, en Lima, a los dieciocho días del mes de marzo de mil novecientos noventa y cuatro.
