LAW NO. 72-40 ESTABLISHING THE COPYRIGHT OFFICE OF SENEGAL

Article 1. A public institution with professional character is hereby established under the name of Copyright Office of Senegal (Bureau sénégalais du droit d'auteur-BSDA).

Article 2. The Copyright Office of Senegal shall be substituted for the African Copyright Office (Bureau africain du droit d'auteur) and the African Office of Writers and Lecturers (Bureau africain des gens de lettres et auteurs de conferences).

In particular, its purpose shall be:

i. to ensure the protection of the material and moral interests of the creators of intellectual works;

ii. to ensure the protection and exploitation of the rights of the creators of intellectual works;

iii. to reintegrate Senegalese authors and to ensure discipline within their professions;

iv. to establish and maintain harmony and unity of action among Senegalese creators of intellectual works and to promote, between them and the natural persons or legal entities employing them or using their creations, such understanding as is necessary for the protection of their rights.

Article 3. The Copyright Office of Senegal alone shall be responsible for the collection and distribution of royalties in all forms present and future.

It shall represent the interests of foreign societies of authors within the territory of the Republic, in accordance with conventions or agreements concluded with them.

Article 4. All contrary provisions are hereby repealed, and in particular the Ordinance of April 14, 1943, establishing the African Copyright Office (Bureau africain du droit d'auteur-BADA), and the Ordinance of April 14, 1943, establishing the African Office of Writers and Lecturers.
