Details Details Year of Version 2009 Dates Adopted: October 15, 2009 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Undisclosed Information (Trade Secrets), Plant Variety Protection Notes This Order, issued pursuant to sections 90(1) and 124(3) of the Patents Act 1977, make amendments to the Patents (Convention Countries) Order 2007 in order to fulfill the international obligations of the United Kingdom as a member if the World Trade Organisation (“WTO”.). In particular, article 2 of this Order declares Cape Verde as a convention country for the purposes of section 5 of the Patents Act 1977. The text of the Patents (Convention Countries) (Amendment) Order 2009 is subject to Crown Copyright protection (@Crown copyright 2009).

The Queen’s Most Excellent Majesty in Council

Her Majesty, by and with the advice of Her Privy Council, in exercise of the powers conferred upon Her by sections 90(1) and 124(3) of the Patents Act 1977(a), makes the following Order:

Citation and Commencement

1. This Order may be cited as the Patents (Convention Countries) (Amendment) Order 2009 and shall come into force on 12th November 2009.

Amendment

2.—(1) The list of countries set out in the Schedule to the Patents (Convention Countries) Order 2007(b) is amended as follows.

(2) Insert “Cape Verde” into the list of countries in proper alphabetical order.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Patents (Convention Countries) Order 2007 (S.I. 2007/276) under powers conferred by sections 90(1) and 124(3) of the Patents Act 1977 to fulfil the international obligations of the United Kingdom as a member of the World Trade Organisation (WTO). Cape Verde became a member of the WTO on 23rd July 2008. This Order declares Cape Verde to be a convention country for the purposes of section 5 of the Patents Act 1977.

A full impact assessment has not been produced for this instrument as it has no impact on the costs of business.
