Retransmission Royalties Criteria Regulations (SOR/91-690) P.C. 1991-2344 28 November, 1991

His Excellency the Governor General in Council, on the recommendation of the Minister of Consumer and Corporate Affairs and the Minister of Communications, pursuant to subsection 70.63(4)* of the Copyright Act, is pleased hereby to make the annexed Regulations respecting criteria for establishing a manner of determining royalties for the retransmission of distant signals.

REGULATIONS RESPECTING CRITERIA FOR ESTABLISHING A MANNER OF DETERMINING ROYALTIES FOR THE RETRANSMISSION OF DISTANT SIGNALS SHORT TITLE 1. These Regulations may be cited as the Retransmission Royalties Criteria Regulations. CRITERIA 2. The criteria to which the Board must have regard in establishing under paragraph 70.63(1)(a) of the Copyright Act a manner of determining royalties that are fair and equitable are the following:

a) royalties paid for the retransmission of distant signals in the United States under the retransmission regime in the United States;

b) the effects on the retransmission of distant signals in Canada of the application of the Broadcasting Act and regulations made thereunder; and

c) royalties and related terms and conditions stipulated in written agreements in respect of royalties for the retransmission of distant signals in Canada that have been reached between collecting bodies and retransmitters and that are submitted to the Board in their entirety.

Sur recommandation du ministre des Consommateurs et des Sociétés et du ministre des Communications et en vertu du paragraphe 70.63.(4)* de la Loi sur le droit d'auteur, il plaît à Son Excellence le Gouverneur général en conseil de prendre le Règlement concernant les critères applicables à la fixation des droits à payer pour la retransmission des signaux éloignés, ci-après.

RÈGLEMENT CONCERNANT LES CRITÈRES APPLICABLES À LA FIXATION DES DROITS À PAYER POUR LA RETRANSMISSION DES SIGNAUX ÉLOIGNÉS

TITRE ABRÉGÉ

1. Règlement sur les critères applicables aux droits à payer pour la retransmission.

CRITÈRES

2. Les critères dont la Commission doit tenir compte pour l'application de l'alinéa 70.63(1)a) de la Loi sur le droit d'auteur en vue de la fixation de droits justes et équitables sont les suivants :

a) les droits payés pour la retransmission des signaux éloignés aux États-Unis en application du régime de retransmission aux États-Unis;

b) les effets, sur la retransmission des signaux éloignés au Canada, de l'application de la Loi sur la radiodiffusion et des règlements pris en vertu de celle-ci;

c) les droits et les modalités afférentes aux droits dans les ententes écrites à l'égard des droits pour la retransmission des signaux éloignés au Canada qui ont été conclues entre les sociétés de perception et les retransmetteurs et présentées à la Commission dans leur intégralité.
