Edict of the President of the Republic of Belarus

No. 440 of August 7, 2002 [Amended as of January 12, 2007]

1. To express the consent of the Republic of Belarus to obligation under the International Convention on Protection of the Rights of Performers, Manufacturers of the Phonograms and Broadcasting Organizations of October 26, 1961 (hereinafter—Convention) by acceding to the Convention with the following clauses:

"The Republic of Belarus on the grounds of:

point 3 article 5 of the Convention shall apply the criteria of the place of recording provided by the point 1 (b) of the article 5 of the Convention;

point 2 of the article 6 of the Convention shall protect the transmission of the broadcasting organizations only in the case, if the head-quarters of the broadcasting organization is situated in a different state and if such transmissions are conducted from the transmitter situated in the same state;

point 1 (a) (iii) of the article 16 of the Convention shall not apply article 12 of the Convention in relation to the manufactures of the phonograms not being natural or legal persons of a different state;

point 1 (a) (iv) of the article 16 of the Convention limits the protection granted in accordance with this article in relation to the phonograms, the manufacture of which is a natural or legal person of a different state, by the time limits and size, by which this state limits the protection of the phonograms granted to them, the record of which is conducted for the first time by the natural or legal persons of the Republic of Belarus."

To appoint the State Committee on Science and Technologies to be the body responsible for implementation of the Convention.

2. To the Council of Ministers of the Republic of Belarus to take measures on implementation of the present Decree.

3. The present Decree enters into force from the day of its signing.
