BROADCASTING ACT

Broadcasting Information Regulations, 1993

Whereas, pursuant to subsection 10(3) of the Broadcasting Act*, a copy of the proposed Regulations respecting broadcasting information requirements, substantially in the form annexed hereto, was published in the Canada Gazette Part I on July 3, 1993 and a reasonable opportunity was thereby given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect thereto;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act*, hereby makes the annexed Regulations respecting broadcasting information requirements.

REGULATIONS RESPECTING BROADCASTING INFORMATION REQUIREMENTS

SHORT TITLE

1. These Regulations may be cited as the Broadcasting Information Regulations, 1993.

SUBMISSION OF INFORMATION

2. (1) Subject to section 3, on or before November 30 of each year, a licensee that charges a fee to subscribers or to another licensee that charges a fee to subscribers shall submit to the Commission a statement of accounts, on the annual return of broadcasting licensee form, for the year ending on the previous August 31.

(2) Subject to section 3, at the request of the Commission, a licensee shall provide the Commission with a response to any inquiry regarding the licensee’s programming or ownership or any other matter within the Commission’s jurisdiction that relates to the licensee’s undertaking.

(3) In this section, “subscriber” means a person who is a subscriber within the meaning of the Cable Television Regulations, 1986.

3. Any licensee that is required by any other regulation made under the Broadcasting Act to submit to the Commission any information requested on the form referred to in subsection 2(1) or on any matter referred to in subsection 2(2) is not required to submit the information to the Commission pursuant to that subsection.

Attendu que, conformément au paragraphe 10(3) de la Loi sur la radiodiffusion*, le projet de Règlement concernant les renseignements relatifs à la radiodiffusion, conforme en substance à l’annexe ci-après, a été publié dans la Gazette du Canada Partie I le 3 juillet 1993 et que les titulaires de licences et autres intéressés ont ainsi eu la possibilité de présenter leurs observations à cet égard au Conseil de la radiodiffusion et des télécommunications canadiennes,

À ces causes, en vertu du paragraphe 10(1) de la Loi sur la radiodiffusion*, le Conseil de la radiodiffusion et des télécommunications canadiennes prend le Règlement concernant les renseignements relatifs à la radiodiffusion, ci-après.

REGLEMENT CONCERNANT LES RENSEIGNEMENTS RELATIFS A LA RADIODIFFUSION

TITRE ABRÉGÉ 1. Règlement de 1993 sur les renseignements relatifs à la radiodiffusion.

FOURNITURE DE RENSEIGNEMENTS 2. (1) Sous réserve de l’article 3, au plus tard le 30 novembre de chaque année, le titulaire d’une licence qui impose un tarif aux abonnés ou à un autre titulaire d’une licence qui impose un tarif aux abonnés, fournit au Conseil, sur le formulaire du rapport annuel du titulaire d’une licence, un état de compte pour l’année se terminant le 31 août précédent. (2) Sous réserve de l’article 3, le titulaire d’une licence doit, à la demande du Conseil, lui fournir sa réponse à toute demande de renseignements concernant sa programmation, sa propriété ou tout autre question relative à son entreprise qui est du ressort du Conseil. (3) Dans le présent article, abonné s’entend au sens du Règlement de 1986 sur la télédistribution. DORS/96-414, art. 1. 3. Le titulaire d’une licence qui, aux termes de tout autre règlement pris en vertu de la Loi sur la radiodiffusion, est tenu de fournir au Conseil les renseignements sur le formulaire mentionné au paragraphe 2(1) ou de fournir les renseignements visés au paragraphe 2(2) n’est pas tenu de fournir ces renseignements au Conseil conformément à ces paragraphes.
