MINISTERIAL REGULATIONS

STIPULATING LIST OF PARTICULAR TYPE OF GOODS AND RULES AND METHODS FOR USING GEOGRAPHICAL INDICATIONS WHICH ARE SIMILAR OR AGREEABLE TO EACH OTHER B.E.2547

By virtue of Section 4, Paragraph 1 of Section 28, and Section 29 of the Protection of Geographical Indication Act B.E. 2546 which contains some provisions regarding the limitation of rights and liberty of a person, whereas Section 29 coupled with Section 50 of the Constitution of the Kingdom of Thailand prescribes permission to take such an action by virtue of authority in accordance with the provisions of law, the Commerce Minister shall issue the Ministerial Regulations as follows:

1. The list of the following types of goods shall be specific goods:
(1) Rice,
(2) Silk,
(3) Wine,
(4) Spirit.
2. In cases where the specific goods as per Item-1 have geographical indications which are similar or agreeable to each other and the geographical indication of specific goods which have been registered or under progression of registration, but being goods which have different geographical sources, the application of geographical indication for the latter specific goods shall clearly specify a geographical source and a country which manufactures the said goods at the annex of geographical indication.
3. This Ministerial Regulations shall come into force from April 28th, B.E. 2547 onwards.
