CCFTA Rules of Origin for Casual Good Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to subsection 13(2)a of the Customs Tariffb, hereby makes the annexed CCFTA Rules of Origin for Casual Goods Regulations.

INTERPRETATION

1. In these Regulations, “casual goods” means goods other than goods imported for sale or for an industrial, occupational, commercial or institutional or other like use.

CASUAL GOODS

2. Casual goods that are acquired in Chile are deemed to originate in Chile and are entitled to the benefit of the Chile Tariff if

(a) the marking of the goods is in accordance with the marking laws of Chile and indicates that the goods are the product of Chile or Canada; or

(b) the goods do not bear a mark and there is no evidence to indicate that the goods are not the product of Chile or Canada.

COMING INTO FORCE

*3. These Regulations come into force on the day on which section 9 of the Canada-Chile Free Trade Agreement Implementation Act, chapter 14 of the Statutes of Canada, 1997, comes into force.

Sur recommandation du ministre des Finances et en vertu du paragraphe 13(2)a du Tarif des douanesb, Son Excellence le Gouverneur général en conseil prend le Règlement sur les règles d’origine des marchandises occasionnelles (ALÉCC), ci-après.

DÉFINITION

1. Dans le présent règlement, « marchandises occasionnelles » s’entend des marchandises autres que celles importées en vue de leur vente ou d’usages industriels, professionnels, commerciaux ou collectifs, ou à d’autres fins analogues.

MARCHANDISES OCCASIONNELLES

2. Les marchandises occasionnelles acquises au Chili sont assimilées à des marchandises originaires du Chili et bénéficient du tarif du Chili dans l’un ou l’autre des cas suivants :

a) le marquage des marchandises est conforme aux lois de marquage du Chili et indique que les marchandises sont des produits du Chili ou du Canada;

b) les marchandises ne portent pas de marque et il n’existe pas de preuve établissant qu’elles ne sont pas des produits du Chili ou du Canada.

ENTRÉE EN VIGUEUR

*3. Le présent règlement entre en vigueur à la date d’entrée en vigueur de l’article 9 de la Loi de mise en oeuvre de l’Accord de libre-échange Canada — Chili, chapitre 14 des Lois du Canada (1997).
